A question about : Illegal bank charges

Hi there,

After following the instructions on this website and attempting to claim back Ј755.55 in 'illegal' charges from Nat West, they offered me Ј375 in full and final settlement. I rejected this threatening them with court and they have just written back basically saying that they will go no higher than this offer and that if I want to go to court then so be it. My questions are:

1) Does anyone have experience claiming back from Nat West?
2) Do they usually go this far and at what stage, if at all, do they usually give in and pay up in full?
3) If I go to the small claims court, how much money can I be liable for in terms of costs or anything else?

To be honest I am really unsure as to whether or not just to accept their offer even though I know this is giving in. Any help would be greatly appreciated and thanks very much in advance.

  • go for it.
i have claimed, or help people claim back from hsbc and abbey..both have caved in by the time you get to court. the amount you pay in fees is dependent on the amount you are claiming (i think you would pay less than Ј100), but it is added onto the amount you are claiming back from them. Read Martin's article: https://www.moneysavingexpert.com/cgi...1050760,24632, and also look at https://www.consumeractiongroup.co.uk/forum/litigation/ for a library of letters and case studies.
There is a forum on MSE too about all this. At the end of the day it is your choice, and you must be aware there is a chance Natwest could close your account, and a small chance you won't get your money back (but this is unheard of as far as i am aware). However, do you think they would offer you Ј300 odd quid if you could take them to court and they would repudiate the claim and wouldn't have to pay you anything? It's a no-brainer!
    Best of luck
