A question about : how do I get my tax code changed to the correct code?

It's come to light recently that I have been on the wrong tax code for a few years, I've been an employee for over 8 years on paye I have no company benefits and no reasons as to why my tax code should be different from anyone else within the company I work for,my employer told me to contact hmrc and get them to explain the difference, I did so and they told me I was on wrong tax code but they said it was down to my employer giving the wrong code,I am going round in circles my employer and hmrc both know I'm on wrong code but neither seem willing to do anything to change it to the correct code

Best answers:

  • You could try this if you have a notice of coding for the upcoming tax year

Otherwise, do you have your P60s for the past four years?
Do you have Notices of Coding for those years?
You are entitled to the standard single person's allowance for those years?

If having checked the above you think that you have underpaid/overpaid tax, write to HMRC enclosing copies of your P60s and ask them to sort it out

  • No I don't have any p60's since everything went to epay, when I moved address I informed my employer but I've only recently found out that my employer hasn't changed my address correctly the address they have changed it to doesn't exist so I don't know what has happened to the p60's if they were sent in the post,I and other employees have had difficulty accessing our epay I didn't think I would need to as I thought with being an employee there wouldn't be any problems with tax, I was self employed for about 20 years before I started working direct I didn't know it was my responsibility to inform hmrc of change of address I would have thought my employer would do that as they were the ones who dealt with hmrc
  • I have phoned hmrc about this, twice, I spent about 90 minutes on the phone to them of which 70 minutes was spent in a queue, basically both times they said my code was wrong but no one is to blame for the wrong coding,as of today my tax code is still wrong according to hmrc but wether or not it will get changed I don't know
  • It is up to you to advise hmrc of your address details
How did you end your self employment with hmrc? did you receive any paperwork back
When you became an employee you would have either needed to hand in a P45 or complete a P46, on the P46 you identify whether you have any other employment so the correct tax code could have been generated
Is it possible that your tax code is assigned to your self employment and hence the PAYE code is for a second job? when did you last complete a self assessment?
  • For the year 2013/14 my payslips say my tax code is 1004L yet hmrc say it should be 944L,at present my code is 1060L and hmrc say it should be 1012L,that's 10,000 tax free earnings plus Ј120 allowance for washing company clothes
  • My self employment was all up to date when I became employed, bearing in mind I had about 6 years trouble free regarding tax codes it's only been the past fee years since things have gone wrong, at no time has hmrc or my employer told me it is my responsibility to notify hmrc of any change of address, how I am meant to know what to do if no one tells me?
  • My last self assessment was 8 years ago I have no second job
  • As far as I can remember I think tax code for 12/13 was 870L my salary as of 2015 is Ј29,000 ,I can't see the point of writing to them as they've made it clear it is what it is,what I cant work out is the sudden increase in the tax code for 2013/14 ,as you say there must be a reason for this but on both occasions hmrc cannot give me any explanation as to why my personal allowance went up to 1040L instead of 944L,I have questioned why the Ј120 was not added on to my personal allowance and on both occasions I was told the same, instead of adding it on to increase my personal allowance they have decided to deducted the Ј120 from my final salary so it looks like I've earned less than what I actually have earned ,basically both times they said 'tough' that's the way we are working it out?
  • So why can't they give me an explanation as to why they have given me the wrong codes?I learn by mistakes I have made, admitting a mistake is the way to learn not to make mistakes again if they can't admit their mistakes then people like me will continue to suffer, if this is the way they are going to treat me for working hard then there's no point in working at all I may aswell pack in and go on the dole, if I haven't got it what's the worst they can do?send me to prison?very cost effective for the taxpayer!
  • Let me explain to you another reward for my years of hard work, due to wear and tear I have developed a degenerative spine disease which has been proven by a mri scan and eventually it will leave me crippled but as I like work and don't want to be a burden to the taxpayer I continue on working I've spent months in excruciating pain and still continued to push myself on, so please tell me is it really worth continuing to work to end up physically crippled aswell as financially crippled by the incompetent hmrc?I am within my rights to go on disability but I would rather continue to the end but this situation with hmrc is seriously making me think what is the point???
  • I am sorry that you feel like this, it was not my intention to annoy you in any way just to make a practical suggestion. Hope you get this sorted soon and my best wishes in the meantime.
  • You haven't annoyed me at all its hmrc who I am annoyed at I do thankyou for the time you have spent replying and the advice you have given,it's just a sad reflection of the state this country is in thanks to our government and useless computerised systems that are meant to be efficient,to top it all the finance department where I work today got me confused with a work colleague who sadly passed away a year ago?this I will take to HR as it would explain the confusion with my tax as I know he did own buy to let properties, this sort of thing should not be happening I couldn't believe it when they called me by his name
  • not sure whether they will reissue but now that hmrc have your correct address can you ask them to resend your annual coding notices which will show the breakdown of how they calculate your tax code which should identify what the additional allowance was for
  • Ok thankyou I will give it a go although I have little faith in getting a correct answer off them going by the last two times I spoke to them they couldn't give me an answer then so why would they give me an answer the next time I try, giving me a correct answer would mean them admitting they were to blame and besides whatever answer they give it will not change anything the damage is done
  • It was your responsibility to advise HMRC of your change of address but this seems "water under the bridge".
Rather than waste more money and time on phone calls, why not simply write to HMRC to ascertain your precise situation and make sure that your code is correct for this and subsequent years?
