A question about : HMRC Harassment

Hi Folks
11 months in to BR & STILL being chased for money by HMRC.
OR has confirmed that the debt falls within my BR (Tax Credits overpayment for period prior to BR). He's told HMRC this.
I've written 3 times to HMRC - all sent recorded delivery, sent a copy of my BR Order, phoned to make sure they've got it etc etc.
I've now got a letter from a debt collector saying they represent HMRC.
I now consider them to be harassing me. What's my next move? Who do I report them to? I'm not interested in their internal complaints process as such. Is harassment a police matter or a civil matter?
I've threatened them with 'harassment' but now need to act in it. What can I do, folks?

  • Your best option at this time is to contact your local MP, HMRC are an odd bunch to deal with and everyone you speak to will tell you something different.
    Stay strong!
  • Use the complaints procedure - whether you believe in it or not.
    If you're lucky, it will concentrate HMRC's minds wonderfully, and they'll sort themselves out.
    If not - and if you are still sure that they have made a mistake - you can truthfully tell your MP etc that you have done all that you could.
    You can also take your complaint to the Ombudsman, if you're not satisfied with the way HMRC deal with your complaint. You can't go near the Ombudsman until you've been through the complaints process.
    I always think that it's a mistake when people declare that they're not going to use a complaints process. To me, that process is one of the stepping stones to be used along the way.
  • I seem to remember a thread from Pippa Girl along those lines, do a search if you can, it was resolved but took a lot of time and effort
  • Yes you have to go through the internal complaints procedure, like it or not. the police will not be in the least bit interested.

    Many thanks. Another letter to HMRC then to comply with their process for complaints (although I've already complained 4 times).
    I've emailed the OR again - they've confirmed previously that the debt is part of my BR - so we'll see what they say.
    Yes, I remember the previous thread about HMRC harassment. My concern isn't so much about proving the debt (if they want to chase it then that's up to them - no way am I allowed to pay it), it's about delivering some kind of consequence for their blatant incompetence. If there isn't any, then I'll stop threatening them!
    Letter to their complaints section on its way, along with letter to MP.
    OR still to respond to latest communication about this.

    Just to close this off. I complained to HMRC (again), this time through the official channel. 5 weeks later I received a response admitting it was all their mistake and that the 'debt' has been included in my BR.
    They're very sorry and didn't intend to harass me...
    They were the very worst of my creditors.

    I was made Bankrupt in Dec 18 and owe HMRC for Ј1000 and I believed that I still had to pay this. It was due to Tax credits overpayment. I am paying Ј30 a month at the moment and have continued to pay this.
    I have filled in my bankruptcy forms but not had an interview with the OR so I cant ask them anything.
    Are you saying that it comes under my bankruptucy?
  • It was for 2013/2014 and yes it was Dec 2104.
  • My accountant defied my instructions and HMRC hit me for a Ј10,000 bill
    They didnt get paid and neither did he
