A question about : help plz missed atos assessment for esa

Hi,

my Auntie is moving from income support to ESA , she filled and sent the form in 09/2013 and since that she didn't hear from them (esa) and keep getting her payment from income support, the problem is 2 days ago she received a letter from esa saying that she didn't attend atos medical assessment on 12/01/2015 and she have to explain why (form bf223) by 20/01/2015 too late now to reply , she says that she didn't received any letter from atos for the assessment appointment
and referring to the bf223 letter her benefit should be stopped by now but she still getting payment as usual and last one was in 30/01/2015 for both income support and housing benefit
She is now confused and don't know what to do
So plz if u have any advice or help in this situation and what will happen next

  • She needs to complete the form explaining as you have done here - she did not receive the appointment letter.
    Your English would be near perfect if you moved away from text speak
  • Perhaps she could phone them and explain that she didn't get the letter regarding the appointment and the BF223 form wasn't received until two days ago.
    One letter going missing and the next some two weeks late being delivered certainly sounds like it could be an issue with her correct address details.
    Your English is perfectly fine by the way. (just avoid using text speech )
  • She does need to phone immediately and explain what has happened. Expect the response to be less than supportive as it's amazing how often no post gets to an address except the one telling them that benefit is going to stop. Strangely that one always seems to get to the correct address.

    I have another question please about the housing benefit : if getting DLA high rate In both components as the only benefit and income is enough to get or keep the housing benefit?

  • If that is the only income whilst you claim benefits you will have to make a signed declaration declaring this is your only income and explain how you are supporting yourself (obviously using DLA payments) provide bank statements to prove there's no other income coming into the household and explain your situation with other benefits.

    My Auntie spoke to them by phone and she explain why she didn't attend the assessment and was told that they will discuss and see if they will give her another appointment
    and was told that the income support still life
    She is asking if they decide to not give her a chance for another appointment or if she failed the assessment will the income support be stopped ?

  • yes, if she fails the assessment or they refuse to give her a new appointment her income support will be stopped.
    she can ask for these decisions to be looked at again, but won't receive income support while this happens.
    she would need to claim JSA during this period
