A question about : help i have a ccj from parking eye

can anyone help?

I have been abroad working since February, and I have just come home this last week to find that I have a CCJ on my account. I found out because my bank had sent me a letter informing me they had reduced my mortgage because of it. I have had no letters at all regarding any county court issue.

I have registered with experian and just been on the phone with the court about this and apparently its relating to a parking eye charge from December last year. They claim they sent me a court summons in march. I 100 percent have not had this.

I did not get the letter and I also was not even in the country. Do i have a way to have this set aside?. Im !!!!ed off as my credit rating has been fantastic so far besides this , and we where considering moving house, which this has now put the blocks on.

I would have paid the thing if i had recieved the summons.

• I believe if you have proof that you did not receive the correspondence then you can get this set aside for Ј155
  If this happens, the CCJ is removed from the Register. This doesn't necessarily mean the case is over - it just goes back to the start, and PE will have to submit the court forms again.

• Cases v PE can be defended and not all of them go to a hearing at all. We see several cases stayed for POPLA or the Beavis case so you could achieve that if you try and get the right Court. Which is your local Court?
• How can I prove that I didn't receive the summons though?
• Guess the question is how did you travel in and out of the UK? Would your passport be stamped in the countries you went to. If you were working, your place of work could easily validate you were out of the country.

• Sorry about hte delay, this is the first time ive been in the country long enough to think straight.
  Im in cheshire, the incident was in somerset. No idea on my nearest court.
  Im planning to hammer this all weekend and get all correspondance i need to out so if anyone can guide me id be very greatful. Ill fight parking eye if i can.
• If you answer the question you've been asked about what your nearest town is, people can help. Cheshire is a big place and is likely to have more than one court.

• I was working in Somerset at the time but then 2 months later went to work in Germany for a year.
  So i didnt get any notification of any court issue. Besides this, my partner was checking my mail and didnt get anything either , so wether it was actually sent is sothing i worry about.

• And to make this worse, i have just had a prospective contract terminated due to failing a credit check.

  Ive looked into this and i remember the alledged icident. I pulled into a range car park in bridgwater on a sunday night around 11pm. I was traveling down for work, my dad called me and i answered the phone so pulled in. Was on the phone for about 30 mins, mayve longer, didnt turn my engine off and didnt even get out of the car.

  its not as if this hasnt been asked and answered many, many times before on here (although this forum isnt a legal advice forum about debt collectors or CCJ`s, they have happened well past any of the usual scenarios this forum addresses, sometimes for other reasons too, not parking)
  the fact the car was stationary on private land is what brought this on, yet people seem to think a stopped car with the engine running is not "parking" , ok well its trespassing then , because you have not received the landowners permission to park or STOP there , pedantic but true - sorry
• I understand that, but the bigger issue is that i never recieved any kind of letter telling me i would be facing a county court judgement. No court letter at all and the only reason i found it was because my bank informed me. I would have paid the bloody thing rather than let it go to that if i had known.,
• its all still after the fact and you want to try to go back to before it all happened
  they did it, might not be ethical or fair but they do it thousands of times a year so you need to get over it, understand it and fight back if you can
  this thread has been here for 4 to 5 months now with no signs of it moving forward , enough links have been provided for you to try to get it set aside like other posters have done , the advice is all in the previous posts and replies, plus in dozens of other threads
  therefore, what do you want from us other than what has been provided for you ?
  there is no easy answer and nobody is going to do this for you unless you pay a professional to sort it out, otherwise its DIY and little will change for the forseeable future until you get down to sorting it out
