A question about : HB and council tax help.

I have had my HB and CT suspended because there has been a change in my circumstance which I notified them of. I was awarded 10k due to car accident. The DWP sent an exemption certificate to me stating that this money would not affect my benefits. I sent this, the amount of the award and a bank statement showing the money to my local authority. At the time of receiving the money I also escaped a violent relationship and moved into unfurnished rented. I used the 10k to completely furnish my new home: beds; stove;washing machine; furniture etc. Some of this I bought using my visa debit card and some cash. I kept some receipts but not all of them. The LA have asked for evidence and I can send them some receipts but not all.I have explained to them what I bought and they have a copy of my rent agreement too showing it is unfurnished. They are aware that my ex is violent and there has been police involvement.
I do not have money to pay rent or council tax. The LA have said this could take up to a month or more to deal with my correspondence. What are my rights to gain access to benefit to cover my rent and council tax in the mean time? I have 3 dependent children and they all have disabilities as defined under the DDA.

  • I think you will have to wait for there decision.Make sure you send all bank statements and maybe just keep hassling them.
    The question that will arise is couldn't you have kept a little of the Ј10k back until this is sorted?
    I don't doubt that benefits will be re-instated but might take a month as all claims take around this time I'm afraid.
  • Any personal injury award is disregarded for 52 weeks during which you can spend it on what you wish.

    As regards not being able to afford your HB and CT just telephone the landlord and council and let them know that you are unable to pay until your benefits are sorted out. If you contact them there is less likelihood of any nasty letters.
    If you rent privately then the landlord cannot evict you for rent arrears unless you have two months of arrears. Even then it would take months.
    In my experience most people are supportive as long as you let them know what is happening.
