A question about : Going to Court Today
Hi,
My court date is for today and am taking to Barclays to court for Ј400.
Will Barclays turn up in court, Do i have to say anything,
If barclays don't turn up, will I win by default?
They have entered a defence,
Any help appreciated before 1pm today! EEK!

- Is this for unlawful bank charges? Are you the Chosen One? Can`t believe that Barclays would risk the bad publicity they will get if they lose - for just Ј400.
Please post back after the case.If they dare go through with it. - Thats the risk you take when you take them to court. No need to sound all scared because you expected them not to turn up.
- What were the particulars you entered for the claim, and what was their defence?
Have you gathered any evidence? - Don't worry OP, you'll be fine. I doubt they will turn up, but if they do, just look confident but innocent and be open and honest!

M - I havn't got any advice but just wanted to say good luck.
- All my evidence was the dates and times of the charges, and letter templates. Is their any other evidence i should get?
Their defence was that basically it was a contract and as part of that contract the charge was lawful and was part of T&Cs and I had gone over my overdraft limit - Fine - if that's their defence, then you shouldn't have anything to worry about.
If they claim it's for a service, then you need to remind them that they are cloaking a penalty.
They also charged you for bouncing DD's etc... I assume?
You should also point out that cheque books, debit cards etc... are all free, so therefore how can it cost £35 to send a letter.
Remember, in a county court it's beyond levels of probability, not beyond reasonable doubt. - Well it is now 2.5 hours after your court case, I do hope everyting went alright for you. Please let us know how it went.

- If it did actually go to court - it was most likely adjourned in any case.
Just like the last time I got all excited - then they settled out of court; of course.
