A question about : Getting paid less than minimum wage.

Hello so here is the story.

I have worked at my current job since November 13th 2013.
My first 3 weeks I was getting Ј440 a month, working 38.5 hours a week. (Not including unpaid lunches)
After that 3 months I now earn Ј520 working the same hours.
I am 20 years old, I am NOT enrolled on a government training course/apprenticeship.
I have read through my contract and there is nothing about me being on a internal apprenticeship scheme.
I confronted my boss about that I believe I am getting under paid and got the cold shoulder and got ignored.

What action should I take?

  • Do you have a payroll/hr dept?
  • No, it only employees 12 people in the whole business
  • If they decide you have been underpaid make sure you get the penalty payments as prescribed by law, not just the pay up to min wage.

    not sure if this is in effect yet but there are older reference in the 1998 act
  • call in the min wage investigators if there are more than you involved.
  • I've sent a complaint form and then going to ring them tomorrow!
    Hopefully I get some money back

    Can anyone help me with some tips on what to put in?
  • Others will know more but you don't seem to be an apprentice - there has to be a training provider with a proper training programme to make it an apprenticeship - not just vague talk about training.
  • I would REALLY appreciate someone to look over my letter and see what I can add.

    Following my recent discovery about minimum wage and the realisation that I am not currently enrolled on an apprenticeship, I am legally entitled to minimum wage.

    My current pay works out as Ј3.37 an hour. (Earning Ј520 a month)
    The first 3 months I received around Ј2.80 per hour. (Earning Ј440 approx a month)
    According to the government website, I should be on Ј5.04 per hour minimum wage.
    With further discussion with ACAS, I am entitled to have the difference back dated and paid to me. It would be highly appreciated if we could come to some sort of understanding and get this resolved.]

    A few questions I have.
    - Do you have to sign a document to be enrolled on a apprenticeship?
    - Do you have to have some sort of paperwork detailing you're on an apprenticeship?
    - What would an "internal" apprenticeship be like? Would I do modules like a normal apprenticeship?
