A question about : Fishing letter from RMA Resolve

Hi

I have received a letter from RMA resolve addressed to me but in my first married name (have many years ago divorced and remarried). It refers to a debt of just over Ј1000 and a client called Arrow. It basically says they are looking for Mrs x and if that is me please contact them, if not apologies but if you know them please advise us etc.

I do not have any debts and certainly none in the last 6 years. When I qualified as a solicitor I had to disclose all debts I'd had in the past which were caused by my ex-husband to the solicitors regulation authority. I had to provide evidence that debts had been paid off and prove my credit file was clear. Since then I have had no further debts but to be sure checked my credit file again. All accounts are up to day and satisfactory. For this reason I know that any debt that they think I owe is statute barred anyway!

So question is - do I just ignore them and hope they give up? Can't imagine for a second they will attempt to issue proceedings. If it was a valid debt they would have just done it by now and not send these spurious letters out!

  • Sounds like you have answered your own questions?
    Either not yours, or statute barred, etc..... Whichever way, probably no point responding unless they make some positive assertions about what they are chasing and from when.
    Two words of caution about Arrow though:-
    - They have a nasty habit of re-recording defaults for old debts on your credit reports using an inaccurate recent date. And/or they are not averse to slapping a default on your report, even when the debt is not yours or it is unsure whether you are the person they are after.
    - They also seem to often obtain a CCJ using a previous address, and then once obtained chase you at your current one. If your credit file isn't initially linked to your old addresses, then once they link you to your new address a CCJ and default suddenly pops up on it apparently out of nowhere.
    So please please keep careful eye on your credit reports, no matter whatever course of action you take. You may well be fine and nothing appears, but forewarned is forearmed as they say.....

    When you say they issue a claim and get default judgment - I take it they don't follow the pre-action protocol and send an LBA then?
  • Hard to say, but if they have in those cases I'm thinking of it's gone to an old address as well so the people involved didn't get that either. I recall a few cases over the last year or two where the first thing the person has known about the CCJ is an order to attend court for questioning!
    Not saying the above happens all the time, or even most of the time, but seen enough examples here and elsewhere to say that Arrow are often not playing fair somewhere.
