A question about : Fence Damaged Neighbours Wall in Storm.

Hi guys , recently in the high winds my mums fence broke and damaged the neighbours wall. The damage is light with about 4 breeze blocks loosened that can be easily fixed with a bit of compo.
His son approached my Mum and insisted she was liable, it would cost her Ј100 and he would do the work, also he stated the fence was illegal as it was higher than 6 feet.
It's 6 foot panel with a 2 foot extension panel on top....sorry...was title=Smile
I've yet top speak to him, and thought it best to find out where I stand legally before I deal with him.

Any advice will be appreciated...thx

  • Unless the fence was already known to be in a state of dis-repair, your mother would not be considered to be negligent - even a new fence, poperly erected will break given a gust of wind of sufficient strength.
    How does a fence wooden fence panel manage to loosen breeze blocks ??
  • The neighbour is right about the fence if it's more than 2m high and can get a council enforcement officer out to order your mother to take it down,
    Re: storm damage I'd suggest your mother talks to her insurance company and they can liaise with neighbour's about who pays.
