A question about : False Application Forms Submitted by Barclay's /Egg Bank
Hi I need some help.
I took out a credit card with EGG a few years back. I noticed that I had CCP which I don't remember taking out. I claimed for miss selling to to the FOS and just under a year they decided not to up hold the claim as I had ticked the box on the application form. I asked for proof of this and was sent a screen shot of the application.
After a month I was looking at the application and noticed that it was not the application I had filled out. It also had added information that would not have been available to me at the time. I.e credit score and agreed credit amount. In short the document had been altered to look like I had ticked yes.
When I wrote to the FOS they said because I had passed the appeal date the case would not be re opened. The problem I don't understand is the document is obviously false so how can they make any decision based on a false document. I have tried to re-open my case but with no luck.
1) is this normal practice for Barclay's/ EEG bank to submit false documents 2) Can I take this further & what are my legal grounds.

2. You can take them to court if you have deep pockets. - How could you actually prove that they had falsified the application form.
Like Krisdorey says, you would need deep pockets and then some..... - For CPP ? The amount paid wouldn't have been very high, it's not like PPI.
How do you remember what was on the form ? - 'made it look as if it had been ticked'
It was either ticked or it wasn't.
Maybe they had to check things ie credit score etc which they would only check after you applied.
The wouldn't do this before you applied because they would know you were going to apply. - I haven't seen the form obviously but it is not uncommon for bank paperwork to have a section for their use only. I.e. you fill in your parts of the application form and then when you have submitted it, they calculate and complete your credit score and what amount of credit they are prepared to offer you. Can't really offer more unless you can scan and post it?
- Ok the section that I supposedly filled out was in a spread sheet with this information as well as the ticked section for ppi.

I would have remembered this whole section. - Those things would have been checked after you applied. ou would never have seen them.
- This was submitted to the FOS as proof of my application for PPI. which they say I filled out on-line. The first part included my personal details ie name & address, work details & time with bank ect. so If this is the screen shot of my online application why is the section for PPI missing.
- so where on the application did i agree to have ppi?
- It says "payment protection Y". That will be where they are getting it from.
- Er... surely the OP would have had his own copy of the paperwork. Is the box ticked on that?
Am I naive or is it right that agents missold PPI by suggesting that applicants take it out as a condition of getting accepted for credit in the first place? - I informed the FOS that I did not remember agreeing to PPI and requested prove of this ie my original application details. I was sent the for-mentioned details which did not include the PPi section. cleverly constructed to look like I had ticked yes for PPI. The FOS said that this was my on-line application screen shot which was provided by Barclay's and was used to determine their decision.
