A question about : EE and Deezer

Hello all - had a little result recently that may be useful to some of you.

I have an iPad and mobile phone. When taking out the phone contract (with EE) I was told I would have full access to Deezer mobile for 24 months.

This access was withdrawn on my secondary advice after Deezer and EE ceased their professional relationship.

I claimed against EE for this misrepresentation. Only a small amount, but still a point of principle. I got full payment of damages. No admittance of liability by EE, however.

  • it's basically spotify - a different company ee had a partnership with.
  • Quite surprised they paid up to be honest. Since their standard terms and conditions don't state that you would have access to the service on other devices, it would have surely been up to you to prove that the EE sales rep had promised otherwise. EE doesn't even guarantee that Deezer will work on the devices it is supposed to work on: "Third parties provide these multimedia products and we can't promise they will always be available or that they will work perfectly."
    My guess is that giving you the money outweighed the cost of defending the case, so they paid up. If more people were to make a claim, they would probably start defending them, though, as the cost of settling would then outweigh the cost of defending.
  • Well yes of course it would be on me to prove what the sales rep said - I bring the claim, I have to prove the claim. I don't think that part is up for debate.
    And yes, I am sure they did weigh up the cost of defending against the cost of paying. I'd be surprised if they did otherwise.
