A question about : does dad really need a will ?

My dad lives with me so has no house. My mum died 9 years ago.
I am an only child. Dads income is his state pension plus attendance allowance. He has no other pension. His assets are savings only approx. Ј50k. His intention is to pass his money onto me. Does he really need a will ? His circumstances couldn't be simpler.title=Smile

    Firstly his estate will be a bit easier to manage with a will
    More importantly he needs to cover what happens should you predecease him
  • It's actually very easy to manage a simple estate when someone dies intestate but the question of your predeceasing your father is the reason you need a will.
    I was an only child and in a similar situation to you and it was because of this issue that we had my father make a will, otherwise his small flat would have passed to ahis sister rather than to my husband, despite the fact that we'd given him the deposit for it.

    If your dad has more than Ј200 in a bank account, you'll find that the bank won't release any money without a will. Also, you'll need to provide a will to show that you are the executor of the estate before insurance companies etc will even talk to you.

    You should be able to find a local charity that [a] feels right for you both [b] is allying itself to the scheme.
    October gives you time to have the main points thought out and set down.
  • I understand that thinking about making a will is not nice. But I am sure that the very last thing your dad would want is for you to be left with a lot of hassle or heart ache. He must have worked hard to be able to have that amount and again am sure that he would want you to benefit.
    Please make sure he makes a will losing someone is bad enough with having to go through the extra legal stuff not having a will might add.

  • Probate asked for a will as did Mums building society and bank account .Executer of the will have had to pay back DWP pension paid out the week after death . Just received a letter from DWP Estates checking on deceased assets . Inland Revenue also run a check .
    So yes a will and keep records of all transactions .
    For a small estate you can do Probate yourself as executer if you have a will .It takes time to sort but is not that difficult .
    Doubt if you would get your hands on the Ј50k savings without a will as their would be no proof of intention .
