A question about : Distributing monies from estate

Hello - as executor of a will I am about ready to distribute the proceeds of the estate (such as it is, nothing major) to the beneficiaries (who are family members).

Simple question really, I think, which is - do I need to do anything by way of them signing to acknowledge receipt of the proceeds or anything?? I believe there is unconditional trust between us and don't envisage that changing however really don't know whether I ought to be doing the above?

Best answers:

  • personally I would get them to sign to say they have got it.
In my experience, where death, wills and money are concerned I would trust nobody. Ive seen some vultures in my time.
Your'e covering your own back too.
  • It isn't unreasonable to ask them to sign to say they've received it.
However, you should anyway be giving all beneficiaries a copy of the estate accounts. This in itself is the complete record of the distribution. I've always allowed that to stand as the record. If they don't query anything when receiving the accounts, they can't really expect to query anything years later.
