A question about : Debt in someone else's name
Hi, not sure if I'm posting in the right place but am really hoping someone can help me.
I joined my 15 year old daughter up to an Exercise 4 Less gym a while ago so that she could go with her friends, didn't mind this at Ј10 per month. After a while she wasn't going enough so we decided to stop the membership.
However, I made a mistake because I just cancelled the direct debit and didn't talk to the gym to cancel it properly.
I received a letter from Harlands (who must look after membership for the club) saying that the DD had been cancelled and that a Ј25 charge had been levied against me. Stupidly, I ignored it and have just received another one saying there is another Ј25 charge and now I owe over Ј60.
The thing is, the letter is being sent to my 15 year old daughter and not me and in fact is being addressed to Mr. She has a different surname to me to. The only link is that the payment have been coming out of my account.
Do you think I will be able to negotiate with them to pay the minimum amount or will I have to pay the whole lot?
Any advice is gratefully accepted.
Craggy
Best answers:
- Who signed the application, and the DD mandate?
- So, how long was the contract for and what were the fees described?
I would be inclined to pay it off and cancel the membership via the correct method. Just cant just welch on a contract, no matter how annoying it is and cancelling a DD does not cancel the contract. - Thanks for your responses.
I did the DD over the phone, don't recall signing anything but I will check that.
There was no contract either as it was supposed to be an easy cancel at a months notice. - You failed to cancel the agreement properly. Call them, give the months notice & pay the fees. You can attempt to negotiate a reduction but tbh, their terms are pretty basic. Give notice, stop paying after notice period.
- In that case, give them a months notice, and pay them their Ј80.
Not worth fighting over it. - Did you sign anything or agree to anything online ?
- Hi, no I didn't sign anything or do anything online. The whole thing was done over the telephone.
