A question about : Date of default and CCJ

Hi, I have 2 Ccj's one with NR and one with Lloyds and neither show on my credit report. I have also searched the Trust Online and they do not show here either. Both are less than 6 years old. I also searched my husband's name as NR is joint and nothing there either. How is this possible? Also in respect of NR they have never added a date of default to the account so on my credit file it shows as late payment- the date of default and ccj is coming up for 6 years so I'd like the date added so that it then falls off my credit report. If not it will continue to show late payment forever! How can I get this amended?
Many thanks in advance

Best answers:

  • Do you have a copy of the CCJ?
Are they paid? If you paid within 30 days they won't show up.
If you have a copy, raise a dispute with the CRA that as you have a CCJ the account clearly defaulted before that date.
Which credit report? All 3 agencies?
  • Are either a mortgage or secured loan, or were originally?
A CCJ is an unambiguous indicator of a default, even if one was not previously recorded, so the account should be recorded as a default at the latest at the date of the CCJ.
The CRAs and registry trust should have records of them if less than 6 years old. Sounds like there is some oddity on the address they may be registered at that doesn't match quite what you are searching against?
  • Thanks for the replies. Neither were settled (and are not settled). The nram loan was the unsecured element of a together mortgage and the lloyds was a personal loan. Nram obtained a charging order contemporaneously with obtaining the judgment as did Lloyds but they only entered a restriction as the house is jointly owned and the loan was in my sole name. So the address must be correct as I know that the land registry are sticklers for detail... also the registry trust searches against the individual as well as the address, so I am a little perplexed to be honest.
  • Scratch it.
