A question about : CSA Advice needed.

We really need some help. My partner has been paying voluntary contributions since they split up five years ago. They briefly got back together in 2003, this did not work out, and when we got back together she decided out of sheer nastiness to go the CSA.

I am dealing with CSA on his behalf, and have had long conversations this week with them as thay are trying to sort out a monthly figure.

What do the CSA take into consideration? The ex wife is on family tax credit, will her new CSA payment affect this?

What advice can anybody give us to make this whole thing abit easier for us?

Any helps and tips would be greatly apprecaited.

Thank you.

Best answers:

  • It does not matter what the income of the ex wife is. The only money that is taken into consideration is his wages. And according to the booklet that we received last week it's 15% for 1 child 20% for 2 children, that is under the new ruling. The old ruling used to be 1/3rd of your wages. Rent, poll tax,and other bills are not taken into consideration. It is taken of your bring homepay.
  • Any maintenance received is not taken into account for the purposes of Tax credits! You could be getting Ј1000 per week maintenance and STILL get tax credits if your income from employment is low! Mad ! Under the "new" system reductions can be made if you have any children living with you.
  • CS1 (the old system) is not 1/3 of the Non Resident Parents income, it is based on a hugely complcated formula that works out the maintenance based on a wide range of vairables. This include:
The current social security amounts set for minimum weekly costs
The income of BOTH parents (if the Parent with care is recieving a registered benefit such as Income Support then they would be classed as having no income)
The housing costs of both parents
The pension contributions of the NRP
and many others, see https://www.csa.gov.uk/dmg.asp for detailed answers
CS2 (the new system) is based on a much simpler formula, and works on a fixed percentage of the NRP's income (15% One Child 20% Two Children 25% Three or more children) - However, it is then further reduced by the number of nights that the child spends with the NRP, so what ever number is reached is is divided by 7 and then multiplied acordingly
Calculators are available for you to have a go at working out your likely payments they are here:

  • I am going through the process at the moment. As my ex is on benefit then the children will not get the money as it goes to the Government and she gets Ј10 a week of it.
I am disputing the amount with the CSA at the moment due to paying previous debts but the clock is ticking and arrears are mounting up. I am in the hands of a variation officer and will have to wait and see.
    Cheers Paul
