A question about : Claiming Insurance Excess From County Council

First off apologies if i'm posting in the wrong place,
Anyway heres my predicament,i've very recently had to claim on my motor insurance for flood damage to my cars engine after driving through a flood in the road,I had no option but to drive through the water because it was either drive through the water or hit a car already stranded in the flood.the car needs a new engine,There were no warning signs of any description on the road,Can i at least claim my insurance excess and rac towing fees back from the county council totaling Ј950.00.

  • Could you not have stopped before you got to the water, parked or found another route.
    I wouldnt hold your breath about claiming from the CC.
  • The argument will be that, you, the operator of the vehicle is obliged to drive leaving the correct breaking distance to avoid obstacles in your path.
    A puddle/flood deep enough to damage your engine should have been apparent enough for you to take avoiding action.
    Also the council would have to been proved negligent. Floods being, by their nature, unexpected it will hard to prove that the council knew of any problem under their remit and failed to deal with it.
