A question about : CCJ in my name that isn't mine

Hi,

I've just checked my credit file and found a CCJ on there in my name, the only mistake being that it is for 'Mr' whereas I am a 'Miss'.

The CCJ infact belongs to my dad, who shares the same initials as me and we live at the same address - the CCJ on my credit report however is under my full name (just with the incorrect title.)

He has contacted the company who issued the CCJ and they have said they are waiting to hear back from the courts before they can cancel the CCJ in my name.

I've contacted the CRA I've seen the CCJ on and they've said there's nothing they can do as it is under the correct name and we share an address (?!)

My question is, do I need to contact the other CRA's separately to see if they can remove the CCJ from my report?
Or will it automatically be removed form all the CRA when the company hears back from the court?

Best answers:

  • Is it on your credit report as Mr or Miss?
  • Its on my credit report as Mr My Name.
I am a Miss, so its clearly not mine, but its in my name (does that make sense?)
  • In that case the CRA here

  • Yeah
So basically for example the CCJ is actually intended for Mr Tom Jones. However, its appeared on my credit report (Miss Tina Jones), however it appears on my credit report as being for Mr Tina Jones.... A person who doesn't exist haha. Hope that makes it clearer.
I'm just keen to get it sorted as its been on there for over a month now, and I am planning on applying for a mortgage later in the year and wouldn't wan't it to affect my chances of being approved.
  • It a double cok up then. The CRA and the company making the court claim. Both failed to make the proper legal check they should.
  • So what can I do about it other than wait for the company to hear back from the court? Do I need to contact anyone myself?
  • Yes, the original creditor used the wrong name, as they've sent letters under my name with the Mr title. I've always just passed them onto my dad as I knew they were for him.
The CCJ has been issued in my name with the incorrect title. However the CCJ is intended for my dad, yet it appears on my credit report, under my name (the name the company has).
I've received no court documents but this may be because my dads opened the letters addressed to Mr Tina Jones (as he knew they would be for him) whilst I've been away at University... This must be the case as he knew about the CCJ and told me he was sorting it out as it had come in my name. However I then checked my credit report for the month and saw it on there.
So in effect he has contacted them to sort it but its still appeared on my credit report, and I'm wondering who/if I need to contact anyone else to get it removed, other than the company my Dad's contacted who have told us they're waiting to hear back from the court.
  • So.... Basically the CCJ is technically mine and there's nothing I can do about it?
  • Surely that's not the case - I was around 3 years old when the 'contract' between my dad and the company was set up so there's no possible way the could be attributed to me....
  • You wouldn't of been on the electoral roll at 3 years old, so how did they obtain your name? What type of agreement is this for? i.e. loan, credit card, mobile phone contract, etc.
  • But some first names can be Unisex and so wouldn't be clear . So why would they not be able to assume , especially when the father was running the account was happy enough to see mail come through addressed incorrectly?..
I once had an issue with an old egg savings account that was never noticeable on statements sent out - it just looked like odd spacing.. in that they thought my account was in the name of "MrS A ...." rather than "Mr S A ...."...

  • My name is a unisex name so that's probably one of the problems.
Exactly, we have disputed that it can't be me for that reason, I wasn't even on the electoral roll then. The letters never used to come in my name, it's only been the last few years, so we assumed it was just an administrative problem and wasn't actually affecting me... Until the ccj has appeared on my credit report, and came and was addressed to Mr Tina Jones (obviously this isn't my real name.)
The ccj is for a utility bill.
