A question about : CCJ enforcement advice

Hi, I won a judgement in the summer on behalf of my very elderly mother. The defendent, a builder, never even showed up at court. It seems it is now up to us to chase him (with further costs), and no guarantees of recovering the substantial amount he owes her. He has a Ltd company in partnership with another man. My question is this. I'm thinking about obtaining a Warrant of Execution. The business address I have seems to be a house, which must belong to one of the partners. Would they both be liable? And can they only remove personal property or is it just items registered to the business? Am furious that even with a judgement against him, he can easily get away with it, not what I would call any justice! The rougue traders will never be deterred.

Best answers:

  • How much are you hoping to get?
Chances are that he will just liquidate the company if it is a sizeable amount.
  • Can you name and shame?
