A question about : Bankcruptcy?

To keep it breif.....

I owe about Ј67,000 all on usual loans etc... and not 1 thing to show for it!

ive tried cccs failed on a dmp.... im 26 in an unsteady relationship of 5 years and two young children, i rent and im the only one that works, im loosing control and all grip on reality!

I havnt paid my creditors for almost 3 years.

Im really cheesed of today got a letter from bank saying that 2 cheques havnt cleared (total Ј28) bank charges Ј78.... im soo mad title=Mad

Not only that got a notice of application for attachment of earnings order from local court, if i do not reply i could face 14 days in prison! A creditor has court up with me and wants Ј17,011 what can i do im skint and behind on my rent and other bills!!!

Bankcruptcy is this my only option? according to the experts, yes.. but its about Ј450ish to go thru with it.... which i cant afford! Plus in my rent contract good bye house if i go bankcrupt!

  • Aww, you're actually in the wrong section here, hopefully someone will be around to move you over and then you'll get lots of help and advice.
One thing you might want to do is start proceedings to recover unfair bank charges like that £78 you mention.
Have a read of this while your thread's waiting to be relocated.

  • "HAve you had some proper advice, i mean not from friends etc. Plenty of helplines out there and I dont mean the Carol Vordamon ones either"
I've had advice from CCCS and Citizens advice and national debt line and they say the amount i owe and what i can pay back isnt worth anything other than bancruptcy! aaaahhhhh
  • I can't advise you on the debt but as far as all the bank charges you have had .go to www.consumeractiongroup.co.uk and register there and you will have all the past 6 years charges back within 9 weeks , with interest .That will go towarss some of the debt at least
Good luck and I hope you get the advice you are looking for
  • Thanks for the link.... all help is greatfully recieved!
  • Just because he's been irresponsible in the past doesn't mean he wants to continue to be. He's trying to face up and has 2 young children giving him the motivation. He's come to the right place to be helped, I hope you don't put him off with that diatribe.
  • Sorry Jackdoor but I dont think your kind of attitude is any helpfull. You know nothing of his situation to make such coments.
Me and my family are in debt... not as much as OP but we are having a hard time as well.
My husband was an aircraft engineer who broke his wrist. He was out of work for over 1.5 years and had to have several operations before it healed up and could go back to any kind of work. Since he worked as a self employee we had no medical cover or insurance to help us out.
We went from earning 3.500 a month to my measly wage of 800 and we are still struggling today nearly 4 years later due to the debt we got into.
    Think before you speak, please
  • I visit this site nearly every day and have done so for about the past year.
i have just registered today to say
    "Well said jackdoor"
  • with an attitude like that, please excuse me if I don't say Welcome to MSE like I would to any other new member.
  • Wrong attitude and not the right place. The OP wanted advice and all you did was knock him down with a sledge hammer.
Not all people can handle cash and funding like you old great one.

  • I really wish there was an 'unthank' button sometimes.
There is nearly 200,000 posts on the wannabe debt-free forum and 128 people viewing at the moment. There are lots of people in debt in this country - take your miserly and unhelpful comments over there instead of kicking someone when they're so obviously down.
  • Jackdoor & Co:
I will never understand bitter people who have no empathy for anyone apart from themselves. Count your blessings while you can, you never know what tomorrow will bring.
  • my husband and I went into an IVA this year.. stops the nasty calls and people knocking on ur door.. its basically the thing before bankruptcy but as youve not got a house (we got that ... unfortunately) we have some assets so it was better for the creditors to agree to the IVA then lose it all on bankruptcy.
It is hard.. but bankruptcy might well be a solution for you. i have a friend who has gone through it and it puts a big stigma on you.. having to put ur name in the local paper announcing ur bankruptcy (dont worry its not on the front page) but its something that sticks and u even have to declare it to insurers for home insurance etc for a certain period.. but if it stops it. you're obviously not coping cos if you were.. then maybe an Iva... but pfft im bad with money so who am i to talk! i went through my IVA with Debt Free Direct and found they gave good advice.. really easy to talk to aswell.
anyway. whatever happens.. you have the support of us lovely MSR's!.. welll most of us are lovely..
  • What a shame that I have read some hurtful comments not to name but one in particular.............I know everyone has their views and money is the big issue on here...... we ALL have made mistakes where money is concerned otherwise we probably would not be posting on this site me included.!!
Treat as you wish to be treated and you cant go far wrong.
Folk come here for help, not to be shot down at their first hurdle....
