A question about : Ba paid me but not my sister who was on the same flight

I claimed compensation for a ba flight that was delayed over 3 hrs. They paid out quickly. My sister who travelled with her family on the same flight also claimed and ba have not paid them and are claiming they do not actually pay and it is up to the CAA.

What would you advise.

  • Long before I became a regular helper, others, Centipede100, Mark2spark and 111KAB to name a few, decided to have specific airline threads, where forumites should post, on the whole it appears to work reasonably well, from some of the historic posts that I've read, prior to this there were threads about the same questions being posted over and over again, the forum looked cluttered and the good information was scattered amongst all the other threads. Hence, the specific airline threads were created. There's a sticky thread at the top, with links to Vaubans guide, FAQ's etc, etc.
    The long standing members on here far longer than me, still prefer things to be like this, so who am I to challenge that, I don't and support their views and my own that questions should be put on the specific airline thread and forumites should not start their own personal thread.
    When I first found this forum I did actually read the FAQ, then read the entire Jet2 thread, I recall I spent three hours reading it, most of my questions had then been answered apart from a couple which I posted in the Jet2 thread.
    I personally have a great deal of respect for a poster, when they have read Vaubans guide, and then post a few questions for clarification in the correct thread, I and others will then bend over backwards to help.
    What I personally don't like, is forumites that think I (we) are here to serve them personally, that want to be spoon fed the information that they seek without putting any effort into reading anything that is already on the forum. Then once they have the information, they never post again and help others, for me that's the right, proper and decent thing to do. Sadly the regular posters are in the minority.
    If I came over as the 'forum police' I can assure you that's not the intention, but I do support the views of other regular posters on here.

  • I know you and some others put a lot of effort in here (not necessarily out of kindness but maybe it's become a bit of an obsession for some of you). I too have been around since 2012. We are all different personalities and but sometimes I think some of the 'forum police' come across as being a little condescending. Sometimes the admin reprimand telling posters off is actually longer than the answer to the question would have been.
    Everyone must recognise that the forum IS very bloated now and finding the info. you require is not always so easy, especially for users who aren't so tech savvy.
    Having said this I do take the point that some people are just lazy gits and want their backsides wiping.
    keep up the good work but remember there is always room for kindness.
    ps I have sent my N1 off now so I will probably be back for some assistance when putting my court pack together.

  • Well it's possible that your sister did not express her claim in the same way as you and as a result it at least appeared to be invalid

  • Just because one person on a flight gets paid out (whether related or not!) does not automatically ensure another/everyone gets paid out. It SHOULD increase your chances, particularly if the claim ends up in court and indeed if you can obtain a sworn statement from another passenger this will assist. Prior to court action you should write to the appropriate airline informing them you are aware that other claimants have received compensatory payments in respect of 261/2004 and give them the time to review their files.
  • There are tons of cases where the airlines have paid out to some people on a particular flight and not others, the most famous I know of is the case of Mr Huzar, who successfully received compensation after the famous Supreme Court ruling, and yet other members of his family on the same flight have still not received compensation.

  • If the OP travelled on their own on one ticket and the sister's group on another ticket, this might explain what happened.
    The OP's sister "travelled with her family" and BA might pay out compo for single travellers without much of an issue but if the claim involves multiple travellers and would therefore result in a larger single payout, they may try harder to avoid paying.
