A question about : ARPR NtK Received after 14 days.

Hi,

Hypothetically, if someone received a NtK 45 days after the alleged incident having never received a ticket on the day of the alleged incident, would they just write an appeal letter stating:

The Notice to Keeper (NtK) was not issued within 14 days of the alleged incident and you have therefore failed to comply with the statutory requirements of PoFA and therefore the registered keeper cannot be held legally liable for the driver’s debt.

or should they use the standard appeal letter in the newbies section adding this to the bullet points in the letter?

  • Depends whether we are talking a police issued NTK or a PPC NTK.
  • PPC NTK, supermarket car park
  • Going off piste can always be risky. Given there are loads of templates to use on here why take a risk?
  • Been a long time since anyone tried a single issue appeal.
    Does the NtK allege in any way that there WAS a windscreen PCN? Which PPC?
  • Not sure as the NtK arrived after I left for work. I remember the incident as the machines to pay were not working correctly and so was unable to pay as you search for your number plate and then pay. The first 2 hours are free anyway (but you still need to use the machine).
    PPC is PCS.
    I didn't mean to have a single appeal item, but was wondering if adding it to the template in the newbies section as another item in the bullet point list would be a good idea.

  • That isn't a PPC, it's a debt collector. They are acting for someone else. Who?
  • Cool thanks for the advice guys, I will send the letter today and I was also going to email the retail park as you never know.
  • It's important you tell us who the PPC is, there is differing advice depending on whether they are members of the BPA, or the IPC.
  • It says Parking Collection Services on behalf of CE Risk, Safety & Security Services Ltd.
    On the BPA members page they are both listed and on the NtK it says member of BPA and mentions POPLA in the appeals bit.

  • I have also just noticed that the NtK says to pay the reduced rate of Ј25 but does not mention the full amount.

    On receipt of a parking charge notice you have a number of options:
    1. Pay the charge at the reduced rate stated on the ticket if payment is received by the 14th day following the date of issue.
    2. Appeal the charge by e-mailing appeals@cleaneventgroup.com or by post to 4 Thatchmoor Farm, Broad Lane, Huddlesford, Lichfield, Staffs, WS13 8QH. Please note that appeals cannot be dealt with by phone.
    3. Pay the full charge within 15-28 days using one of the methods below.
    If you fail to pay within 28 days, further charges may be applied. We may contact the DVLA to request keeper details with reasonable cause.
    For some strange reason they have forgotten to mention POPLA. Must be an oversight!
  • Their NtK does mention POPLA on the back.
    Could their not detailing the full charge be a point to add as aren't they supposed to offer at least 40% discount for quick payment?
