A question about : Andrew Wilson and Co

My partner got into some financial trouble in late 2011 due to customers not paying her. In 2012 she was taken to court by Printed.com via Andrew Wilson & Co for Ј3,700.

At court, which they did not turn up for, we made an offer to pay back Ј40 per month which the judge/magistrate accepted.

Andrew Wilson & Co have stuck Ј1,800 worth of enforcement fees on. They are charging interest at Ј0.89 per day. Out of the Ј40 they are taking either Ј10 or Ј16.67 per month for their fees.

They have also charged an additional Disbursements of Ј990 including Ј690 for a revisit that never happened and was not needed as all payments have been met. At worst they have been a few days late but only occasionally. Disbursements also includes case set up fees, land registry search fees, instalment arrangement setup fees and broken arrangement fees

None of this seems right to me but I would like the opinion of someone more knowledgeable in this area.

We only found out about these fees when I was going to pay the balance off but was shocked to see that after 2 years of paying off Ј3700 the balance was over Ј5500.

  • You need to read the text of the judgement. It's unlikely that it includes ongoing interest. Once you have paid that, you have paid it and that ccj cannot be enforced.
    If it does include additional sums then you will have to clear these too.
    They could try to get a second ccj for the additions but you could argue against that.
    If this is a lump sum that you are proposing to pay then you could try to negotiate that this be in full & final settlement of the account.
  • Tell them to do one; usually the amount you have to pay is stated on the ccj. This doesn't stop unscrupulous solicitors(yes, there are many) from trying to top up their eye watering profits. Stand up to them and if they don't cooperate, get them to explain to a judge why they are charging more than the original ccj; love to be a fly on the wall for that!
