A question about : 1 gym membership 2 contracts please help

Back in March this year I signed a 36 month gym membership contract - I know really stupid thing to do, the woman was sooo pushy! anyway it was with DEBIT FINANCE COLLECTIONS. The price was Ј16.50 per month and didnt include personal training, creche etc.

After a month I was struggling to get the kids looked after so that I could go so I asked if I could add the extras on and the manager said I could so I signed another contract for Ј15 a month on a 35 month contract...... what I didnt realise was this contract was not with Debit finance collections, it was with Ashburn Financial Services LTD.

So I now have two different contracts with two different sets of T&Cs.

here are their early payment options
DEBIT FINANCE COLLECTIONS:
If you have selected a contract term which is greater than 12 months, you will be required to pay: (the remaining balance for the first 12 month period if any; and a sum representing the difference between the highest monthly membership option and the amount of your lowest membership option for each month you have already made. For example if you choose a 36 month and decided to cancel in month 10 you would be required to pay the remaining 2 further installments and the difference between the 36 month contract price and the highest monthly membership option indicated here for each of the 10 months you have been a member plus a Ј15 collection fee.

So after a year, should only have to pay a collection fee.

then ASHBURN FINANCIAL:
THERE IS NO GET OUT CLAUSE!

When I spoke to the gym manager about this she didnt even seem to know the terms!

Next year I want to go to college full time and then hopefully Uni the year after so am not going to have time to use the services and creche etc. But cant just cancel the gym membership and keep the creche and personal training one going?!!

Any advice would be so gratefully received, sorry for the longwinded story!

  • There is some advice here:

    Hope it helps a little.
If not, and you require further help, then I should take your two contracts to your local CAB and ask for further help.
  • thank you so much for taking the time to reply, this was very informative!
  • Hi Donna - it is good to learn that you found the information on our Adviceguide website useful, and thank you for the positive feedback which we'll pass on to the team that runs the website.
If you need more help and support, then we'd recommend contacting our Consumer Helpline (08454 04 05 06, Mondays to Fridays, 9am to 5pm) or your local bureau. And it would be a good idea to have both contracts to hand, either when you call or visit in person.
