Hi i am just coming to the end of a trust deed but am having difficulty getting the extra on my mortgage to pay of the last part. does this meem i will have to sell my house?

Hi everyone,

I just received stage 3 from Payplan, and i'm thinking stuff that for a game of soldiers whereby the amount I would pay back would be Ј800 less than the TOTAL outstanding debt, with payplan taking over 7K in fees.

So im not going to sign the form they want me to, to put the offer to my creditors. However I signed the form regarding lodging a limitation on selling the house (with the land registry)

A question about : Opening current account before an IVA

Hi all,

It looks like I will have no alternative but to go for an IVA, having recently taken an Ј11,000 pay cut.

Anyway, from reading Martin's advice I think I need to open a new current account before registering - some of the unsecured debt is with our current bank, where I hold a joint account with Mrs DeToy.

A question about : Trust Deed Query

Hi all,

I have a protected trust deed which is due to finish next January.

I have recently began a new job (no wage difference) and need a car to get to my place of work.

My husband (who I married after the trust deed was signed) has recently taken out finance for a new car but since he cannot drive the car ownership is in my name.

Before I contact the TD company, does anyone know how/will this affect my TD status?

I have an IVA with my partner and we have another 3 years left to pay on it, we pay Ј400 a month on this, and also have a car finance which we kept seperate from the IVA, which is Ј250 a month, we are starting to struggle paying the IVA any ideas on how we can get out of the IVA.

A question about : IVA Help!

Hi,

I run a small coffee shop and have recently entered into an IVA. Since the IVA has been accepted I have realised that I have left a couple of my creditors off the list I gave the IVA company. These people were not invited to the meeting of creditors and did not vote on the arangement. Are they still bound by the IVA or can they continue to chase me for the money I owe them? Does failing to inform the IVA company about them count as breaching the IVA?

This is a question I added to someone else's thread on DFW, but it was suggested I post here for advice:

If you've agreed to an IVA of say 50% of debt plus fees of ЈX, in year 4 of the IVA, if you had the equity, could they force you to remortgage for the remaining 50%, so in actual fact you would have paid 100% debt plus ЈX fees??
