A question about : wont repair under warranty

i bought a toshiba satellite L50 in october from very
i noticed on monday that 3 screws had gone missing from the underside, i only noticed as the top and bottom casings came apart upon which the plastic by the power socket had cracked. my laptop has not been dropped or rough handled.
I called very who told me to call toshiba so i did.

they wont repair/replace my laptop

I MUST ITERATE THAT I HAVE NOT TAMPERED WITH IT IN ANY WAY

before they even collected it they in not so many words said i had tampered with it, upon inspection they would see i have not.

when i open/closed the lid you can see the plastic flexing under the force needed to perform this action, could this cuase the screws to come loose, therefore weakening its structure and cracking?

this is a design fault right? there for not fit for purpose? its not even 5months old.....

now i have to pay Ј64 to get it back!

what can i do, i have already called very, whom called toshiba all i got was call back monday

please can someone give me the ammunition i need to get this sorted i have video footage of the plastic flexing under the pressure of closing it and photos before it got taken away

  • If they wont repair under warranty then they are probably saying its user damage .Have they sent a report gave an indication of the problem .
    Your rights under Sale Of Goods Act are with the vendor not Toshiba .
    So you go to Very with the problem .
  • thats what i thought, think i will be givinga call to trading standards on monday, they didnt send a report just a letter saying they wont do it under warranty and the options i had... i did call very, they called toshiba, called me back said to call back monday......
  • I bought a new Dell laptop a couple of years ago and a couple of months after receiving it I noticed that there were a number of screws missing from the bottom so I wouldn't be surprised if this happens fairly often.
    In my case there was no damage and no warranty claim and I managed to get a few screws from the IT dept of the company I work for, but if I hadn't noticed and had to send it off for repair at some stage, I bet I would have also been accused of tampering with it.
  • Dell are strange. i have a Dell laptop and 10 months in the hard drive gave this load grinding noise and then a snapping sound and stopped, so contacted Dell who sent out an engineer who looked at the back and stated you have tampered with this so i cant help ( reason 1 of the screws was silver and not black) i told him that's easy it was missing when i opened the back to increase the memory and here's the old memory and the receipt for the new memory. he then agreed to look and when he opened the back the HDD had exploded inside. He told me the laptop was beyond repair. He called his office who told him they would contact dell and get back to him. 5 mins. later they called him back and told him to take away the old laptop and they would replace it. I was expecting a refurb unit after 10 months, but i got a call from Dell asking me for the order number so they could build a until to same specs.
  • Sounds like Very boxed up a customer return and sent it to you, you need to hassle Very, Toshiba won't repair ANY plastics under warranty.
