A question about : What to do next? Experian Arrgghhh!

Hi, I appologise if this post is in the incorrect place.

I have a Natwest loan account which is defaulted on, default date 18th April 2007, but only applied for and backdated from September 2012 as Natwest confirmed that correct procedures were not adhered to and they promised to rectify as I only foud out when I looked at my credit report.

I currently pay Westcot debt management an agreed amount to repay this and have kept to the agreed payments up to date.

My issue is with Experian.

This is the only credit reference agency who still shows the account as 6 payments late instead of Default How can I get this changed to the correct information?

I have rang both Natwest and Experian and sent letters back and forth with evidence from Natwest that it should show as default. Even Experian have confirmed that Natwest have told them about the default but say that Natwest continue to report it as though it is a live account.

I'm all confused as to what to do next. Natwest obviously kept to their end of the deal as Call credit and Equifax would not have been updated with the correct information. Experian just wont seem to budge on the matter and I just feel like crying.

Any help is much appreciated.

  • Not sure and can see why it is stressing you. Experian are reporting what they receive so not sure they are to blame for the wrong data pulling through to the report.
    Does anybody know if the ombudsman can do anything? My next step would be a letter to NatWest saying you will involve him if it is not changed, but that is based on a non expert opinion. Have a read up and see.
  • thank you for your reply. Natwest say that they notified all credit report agencies in September in a letter I received this morning and 2 out of the 3 have implemented this. I can only think that it has to be ICO or FSA next but not sure how long I should give Experian to do yet another dispute investigation.
  • I've just got off the phone from the ICO to clarify that I can complain to them regarding this matter and I will be gathering all my evidence together to send to them next week (as I will have to borrow a printer and scanner from my parents). I will keep the thread updated when I hear of anything else from either Experian, Natwest or the ICO.
    Any other comments are still welcome.
  • I have been spending most of this afternoon/evening getting together all my correspondence for the ICO for my complaint. I have just emailed the complaint over with attached files so can be picked up next week. I have kept a paper copy for myself just incase. If I hear anything else I will post again.
  • Just a quick update, so I know what I have done and when lol.
    Received email acknowledgement from ICO to tell me that the email had arrived safely. But nothing other than that.
    Experian still say they can not change anything without permission from Natwest (same old same old).
    Put in a complaint to the FSA today about Experian not updating file correctly and it showing missed payments etc and not default from correct default date. Should be getting a letter from the FSA with details of the complaint to read, check, add information/evidence, sign and send back etc.
    I will see what happens. I have the feeling this will be a VERY long drawn out process.

  • I have just received an email back from Experian with some good news
    Dear Miss Smedley
    Thank you for your e-mail.
    I am sorry to hear about the issue you are having with your NatWest Loan account. Having looked into this I have found that whey they have sent through their monthly updates to us the account is showing as active and in arrears (as you have seen on your Experian credit report). Having contacted them again for you they have confirmed that the account was defaulted on 18/04/2007. I have changed the record to reflect this. Your report will be updated within the next seven days. You may wish to log in and view the change once it has gone through.
    I will also contact NatWest again to ask them to look into why the account has been passed through to us as an active account on their monthly update so they can make any necessary changes to make sure it is sent through to us correctly in future.

    I know it may seem silly but I am thinking much much happier now, I think its just knowing that it wasn't just in my head AND also because it will drop off just over 3 weeks.
    I have replied back to him thanking him for his help and just to clarify that the late payments will be removed as you look at my file and it shows 1 account overdue with 4 late payments ie this one lol.
    On a slightly separate note, if everything goes according to plan with the late payments being removed would this effect how I am seen to lenders? I have a few defaults on my accounts anyway which will not drop off for a few years.
