A question about : Wages Arrestments

Hi there everyone,

I'm new and not sure if this is the correct thread so please correct me if I'm wrong!

I'm posting on behalf of my partner who is in a bit of a pickle having received 2 separate earnings arrestment orders, one from the CSA and one from Scott and Co. He is the person in the office most often and has both of them (one was received on 23/11 and the other this week) and he is scared to give them to his boss as he works in a Legal firm.

I have looked online, and from what I can see, the council have to send out advice at least 12 weeks prior to the arrestment, which they have not done, does this make the arrestment illegal? In addition, he wrote a letter to Scott and Co in September offering to make monthly payments via direct debit, to which he received no response. Is there anything he can do before having to hand it to his employer and risk losing his job?

With regards to the CSA payments, to cut a long story short there is a court order to see his children which is regularly broken by his ex partner and they were in dispute over money, the arrestment is for Ј260 PCM, he only gets Ј1000 PCM, by the time this plus the money for Scott & Co is taken, we will be left with around Ј500, which isn't even enough to pay the rent, let alone anything else. Please can someone offer some advice?

  • I don't think this is the board for you. I'll alert one of the board guides to move your post to somewhere more suitable.
  • With regard to the CSA part of your post, I assume he has not been paying child maintenance each month which is why a DEO has been applied? The CSA can request up to 40% of his earnings which they are requesting only 26%. He wont be able to stop this happening, even whilst in dispute.
    Is he in dispute with the CSA or his ex? Just a note that CM and access are not linked so if he sees them or not, he still has to pay CM.
