A question about : TSB Creditcard Indemnity Claim

Hi guys,

I need some help desperately. In summary:

I paid Ј800.00 towards my creditcard bill on 28 Dec 2013.
The direct debit for Ј713.71 was taken from my credit card bill on 30 Dec 2013.
Ј713.71 was returned to my account on 8th January 2014.

TSB are now saying that I owe them Ј713.71. The first I saw of it was when I opened my creditcard bill in December 2014 and it showe an indemnity claim of Ј713.71. I asked them to prove to me that I owed it to them... after 2 months they have now shown that I do owe them the money.

Problem is that this is 14 months after the original problem and I now don't have a job and live abroad. They have told me that I still need to pay it. I am appealing it with them at the moment.

My question:
It has taken TSB this long to contact me (they said that if I cancelled my creditcard before the indemnity claim they would have probably written it off). Can I ask them to write it off because its taken so long to contact me?

Under the direct debit guarantee should they have dealt with all of this in Dec 2013/Jan 2014?

Ј713 is not a small amount for me and I just don't know what to do as this is 3 months rent for me right now.

Any advice welcome.

  • You can ask them, but most likely they will refuse.
    I don't understand what actually happened and why you owe Ј713, but I don't see what exactly you wanted them to prove and how as your bill normally proves everything. If you paid Ј800 and still owe Ј713 then original debt had to be Ј1.5K.
    DD guaranty just allows you to claim back the money taken wrongfully (technically breaching the DD procedure) and bears no relation to what you actually owe to the DD originator.

    I pay my credit card bill off every month so it came as a massive surprise that they said I owed this money when I didnt know about it for over a year....
    I paid them Ј800 manually and then Ј713 went by the direct debit so I ended up paying them twice. It now transpires that the bank and creditcard didnt speak to eachother until now and they are now saying I owe them the Ј713 which was refunded to my bank account. I am confused and skint...
  • So, what exactly happened? If Ј800 was supposed to pay the bill in full, how come you owe Ј713?
  • I owe them because i paid them twice and then my bank repaid me under the direct debit guarantee and now TSB are saying that they and my bank messed up and didnt take the money off my credit card in Dec 13 when they should have :-(
  • What you say makes no sense.
    If your bank repaid you and failed to take money from TCB CC, then TCB owe you, not vice versa.
    Also, you probably owe to your bank.
  • How did you pay twice? You talk about taking the money off a cc but if you paid them Ј800 where did that money go? Surely you should be in credit? Did you pay one cc with another? Did you pay 800 quid then do a dd claim to get the money back after they took the dd? In which case surely the 800 you paid would cover the bill?

    Then you paid Ј800.
    Then Ј713 was taken and you claimed it back.
    The remaining debt was Ј713 - and you knew this from the very start.
    Correct?
    Surely you have to pay what you owe. Consider yourself lucky if they don't add interest.
    If you don't care about your credit history and/or have no plans of returning to UK you can chose not to pay, but this is a different question.
