A question about : Statute barred and now being chased

Please could somebody give me advice....
I have an old debt (pretty sure its stautute barred) for Ј469.00 on an old credit card which I haven't heard about in years.
Anyway I recently started receiving letters from Red Debt Collection Services chasing this up. I received a letter today offering me 50% off the original debt if I pay within 10 days......the threat is to send field agents after 10 days to discuss face to face. What shall I do??
I only moved into my current address 9 months ago and the letters only started 2 months ago.

  • If you are certain that it is statut barred, send them the normal letter stating this.
    Also tell them tht if anyone turns up at your door, you will treat it as harrassment and report them to the appropriate authority.
    You could pay it if you wish of course, you seem to acknowledge that you owe

  • I've had a succession of letters from these people chasing a Statute Barred debt. Even though I am a dab hand at dealing with chancers like this, I decided to test the water on this occasion by ignoring all of their letters. I also felt they quite frankly weren't worth the effort of responding to. Hopefully my experience will be useful to anybody reading this in future. The methods they use seem to become more and more desperate with every letter you ignore. The results of my little experiment are as follows:
  • Letter 1: We demand the full amount immediately - or else!
  • Letter 2: We still demand the full amount immediately - or else!
  • Letter 3: We can offer to reduce the amount by 50% if you pay it within 10 days. If you don't pay we will send someone to your home to "discuss face to face your reasons for non payment".
  • Letter 4: Make us an offer of what you can afford.
  • Letter 5: We can offer to reduce the amount by "a huge" 70% if you pay within 15 days.
  • I haven't heard anything from them for a few months now after this two month period of fortnightly letters. I genuinely feel disappointed that they've seemingly given up. I find their threatening letters comical and they make me smile
    Would they really be offering such large discounts if they weren't acutely aware that a debt is not legally enforceable? So my advice to anybody who receives a letter from these people is to not panic when you receive their first letter. Just sit it out and decide for yourselves if you'd like to pay them or not. Obviously this only applies if you're 100% certain that the debt is Statute Barred. If it's not SB you'll need to take this very seriously and ensure that proactive steps are taken against them (excellent advice is available on this from extremely helpful people on other MSE forums)

  • Hang in there Fyffes.
    In another 6 months, they'll be offering to pay you.
  • They will know if the debt is barred, writing to them will just confirm they have the right person to pester and they will turn up the heat.
    Ignore them, in the off chance anyone does turn up, just tell them to Foxtrot Oscar !
