A question about : section 172 rd traffic act 1984

hi everyone after some advice from a letter I received today
a notice of intended prosecution and requirements to supply driver details.

the letter states my car is alleged to have exceed the 30mph speed limit contrary to section 84 and 89(1) and schedule 2 of the road traffic offenders act 1988 a female diver at 08.31 on 17th feb.

I a MR would have been driving on the rd at this time.

the letter does not state the speed I was doing and it states a female was driving??

what is the best course of action for me to take ? may seem like a daft question but in all my years of driving this is my first time

  • Name the driver.
    Depending on the alleged speed, the driver may get offered a course.
    If you are sure you were the driver, then that will be all. You could ask for the photo's but this does not stop the clock on the deadline to return the S172.
    It could just be as simple as a typo by the $camera partnership.
  • yes it was me driving but they have stated it was a female??
    I just assumed they would tell me my apparent speed rather than just saying I was exceeding the limit
  • the letter states it was an officer that saw me not a camera

  • all I saw was a guy in a HV jacket did not even look like he had a camera in his hand

  • Depends on how much trouble you want to make for yourself.
    Whilst these battles can be won, it's not often ... and those that lose, lose big compared to the penalty that was initially applied.
  • its not a case of arguing it more out of curiosity as I don't look like a woman I have a shaved head and a beard
  • You are not entitled to see evidence unless you plead not guilty and go to court. What you can do is ask to have photos in order to help establish the identity of the driver.

  • pretty sure they will not be a photo though unless someone was hiding in a tree
  • if I ask for photos to help identify driver and one is not produced do I just still admit it and hope for the best

  • ok think ill ask for the photo (souvenir reasons only) then when they fail to supply this ill admit it was me not a women driving and fingers crossed I get a speed awareness course.
  • That's what I would do. Don't miss the 28 day deadline though. They may not have a photo but it sounds like they have an independant eyewitness ie the copper.
