A question about : Pregnant & stressed out

As a relatively new member to the forum I hope I have posted in the right place.

I am having issues with 2 companies - MCE Portfolio and more recently Nolans Solicitors.

A number of years ago I got into a lot of bad debt because of an ex-partner. Most of this is now either cleared or statute barred. I recently received correspondance from an MCE Portfolio regarding a very old car loan. I replied to confirm that I did not acknowledge this debt and that it was in fact statute barred due to the fact there had been no acknowledgement on my part or payments made in over 6 years. It appears the debt has since been passed to Nolans Solicitors who have today written to me to advise that a payment was in fact made in 2008. This IS the case for this debt but at the time the debt was owned by a Marlin Financial Services, to whom I did make a payment. It appears to have been sold on from GMAC: Online Finance TO Marlin, THEN to MCE Portfolio so no wonder I've lost track. I am now being threatened with court action from Nolans.

What is the best course of action now? the debt itself will be statute barred in May of this year (Scottish debt) but in the meantime can Nolans really take this to court?

Any help would be most appreciated.

  • 2 courses of action.
    i) Continue to ignore and hope it goes away (either via statute barred or them not taking you to court).
    or
    ii) pay it.
    How much is it for? depending on the amount it may give some understanding as to whether it is huff and puff or whether they will take you to court.
    I'm all for number 2 but I am not in the business avoiding my liabilities.

    Thanks for the response. The value is in excess of Ј4100 so I am scared to ignore it but at the same time not in a position to pay either

  • I would have thought for that kind of figure they would be very serious about pursuing it.
    I suggest you get yourself down to the CAB for a bit of personal advice. It may be best to see whether they do pursue it and if they do (i,e, go to court) you could come to some arrangement to pay.
    It may look better if you do this in advance but then it would mean ultimately it would have to be paid back as it wouldn't become statute barred.
    Risks at every turn I am afraid with this one.
  • This is not a debt I've ignored in the hope that it would disappear - simply yet another that I wasn't aware of that has been passed from one company to another to another that I've only just been made aware of...definitely risks with either course of action...

  • I got into a lot of bad debt years ago (long story, I wont bore you) - it's taken me years to get it all cleared - either by clearing it myself or due to it becoming statute barred. This was one that I DID make a payment towards in 2008 but then forgot about it and havent received any kind of correspondance on it til recently. So when I received a letter about it 2 weeks ago i wrote back to claim the debt as statute barred and received a letter from Nolans saying the debt is not statute barred due to my 2008 payment. I didnt recognise the debt when I got the letter 2 weeks ago as a) I havent heard of the company in question as they bought the debt from another company who were also not the original creditor and b) the debt is no longer even on my credit file it's that old

  • I need some guidance here folks...this debt isnt even on my Credit file...MCE never provided Experian with any info, I've not heard from them until recently and am now being taken to court by Nolans for a debt that is months away from being statute barred do you think there is ANYTHING i can do here?? any help would be massively appreciated :-(

    I am new to this forum but i am looking for information on who Nolans Solicitors actually are? Received a letter from them today and internet information is pretty sparse, with some saying they are a debt collection agency? Any information or advice would be so welcome. Many thanks x
