A question about : ParkingEye lose in court

I am coc-a-hoop. I have just won my case against ParkingEye.

This after they told me via mediation that they had won every case since Beavis so that I should give in.

Will get nearly Ј124 off them for earnings and travel costs.

More details later as I am on a train.

  • So, which car park was it where the signs were insufficient?
  • I should also add that the judge did say that the decision on the signage should have been the end of it but he also gave his views on the rest of the case.
    Standing to bring the case - Judge said that by a very narrow margin he agreed with PE. Although he did criticise them heavily for the redaction. He also said that their use of the commercially sensitive argument was not a valid one.
    Judge Molonley - Beavis case. PE relied heavily on this and again he said that PE had just about done enough to persuade him.
    I have to say, perhaps if I had come up with better arguments or a better delivery of argument, I reckon I could have won those too.
  • any chance of naming and shaming the car park?
    If this was a supermarket chain then I would be seeking full on publicity against that supermarket, highlighting the stress anxiety worry etc etc that this supermarket ( or retail park/car park owner) has caused you as a result of their agents actions - and I would also be demanding that the car park owner take action to remove parking eye, or disable their systems ( black bag over cameras?)

  • I would also like to thank everyone on this forum.
    While I discovered this part of the forum quite late in the day (and hence didn't do all the right things - eg ignoring the PCN initially), it was a great help.
    While I'm not good on the legal side, I am quite happy to help anyone else based on my experiences today.
    I think had I been better at putting my case I would have won on the other points as well. But a win is a win.

  • Flemming way?
    If theres a coffee shop on site and you overstayed as a result of using the facilities on site then theres something wrong with parking eyes operation. ( although that can be said as a whole parking eye etc do not care about parking management - only maximising their profits from the sites that they infest.
    if this is the flemming way site, then the Range/Halfords are just tennants and could possibly be equally !!!!ed off at parking eye as you ( well maybe the local managers )
