A question about : NHS Staff parking fine

My relative has received a fine from the staff car park at East Kent NHS Trust, she works at the hospital and has the relevant permit displayed. The hospital is BPA approved.

The ticket was left on the windscreen and says she was parked in an area not designated for parking, however she claims to have parked in a space. As she lacks basic common sense she didn't take a photo to prove this, so as yet I only have her word.

I am the registered keeper of the car and havent received any letters yet, the offence happened 11 days ago. Should I email them and say she claims to have been parked in a space and do they have photographic evidence to prove otherwise or is it best to just ignore it? Should I wait for them to contact me as the keeper. She already pays an extortionate amount to use this car park for the privilege of working in a hospital helping others, although its only Ј20 if paid within 14 days, I'm not keen on paying it if its unfair.

Two years ago we got an unfair ticket there and Roxburgh got involved and eventually went away.

  • Oh and I have read the newbies thread and am unsure if this is a small company and do I need to wait for a letter or appeal now as keeper? Last time was pre 2012 changes and there were no letters, just sticker on window followed by Roxburgh rubbish!
  • You haven't said which PPC it is but with most, do nothing yet & wait for the NTK.
  • OK, still wait for the first letter as it will be a pile of pants and not a compliant NTK, which gives you a lot more elbow room!

  • Just an update incase anyone else is going through this with this lot.
    A notice to keeper was sent within the timeframe, it had all the required details on it as per the sticky thread. It's come from PCN Parking Solutions, responded with the email from the aforementioned thread and they replied that they will contact me when they have the outcome of my appeal.
    Will update again with any further correspondence.

  • Complain in writing to the PPC that they are telling lies, that a keeper's appeal window starts the date of the NtK not the alleged offence. (Most PPCs have tried to pull this scam at one time or another).
    Complain in writing (email is OK - addresses in the NEWBIES thread) likewise to the BPA that one of their members is in breach of the BPA code of practice by trying to deny a keeper their legal right to an appeal.
  • PCN Parking Solutions is just another trading name of SolutionLabs Ltd who are effectively the debt collector (and in the IPC). You should have sent your appeal to East Kent Hospitals University NHS Foundation Trust who are the Operator and are in the BPA.
    Resend your appeal to the East Kent.
  • But I have an email from PCN Parking Solutions thanking me for my email and advising they will contact me with the outcome of my appeal. The NTK didn't have any contact details for the NHS trust. As the registered keeper I haven't been given their contact details, only those of this debt collector.
  • Also today's email claims full details of their clients claims have been sent to me by them previously. This also hasn't happened. I have only ever received the NTK which it seems came from a debt collector and not the PPC.
  • Paragraph 9 of the Protection of Freedoms act has the following clause.
    (h)identify the creditor and specify how and to whom payment or notification to the creditor may be made
    My NTK clearly didn't specify how I can notify the creditor, it only had contact details for the debt collector who sent it. It also states that as the registered keeper I cannot appeal unless under exceptional circumstances, and the drivers appeal window has lapsed.
  • I have tried to find the contact details this afternoon for the trust car parking but can't even find it on the website. Not sure if its on the original windscreen ticket as its been misplaced. Baring all this in mind do they have much of a case against me as keeper or should I just ignore them now?
  • I thought your relative worked at the hospital? Should be easy enough for them to find the people who handle such things.
    Personally I'd email the Chief Executive, Stuart Bain (stuart.bain@nhs.net) and it will get passed on.
  • Thanks for your reply, unfortunately as I said she lacks common sense and is highly likely to identify herself as the driver while making enquiries. I haven't involved her in this since she gave me the ticket. I'm mostly worried about them taking her permit away if she gets involved. At least if it does escalate I can prove I worked alone.
    In any case its pretty irrelevant as what if she didnt work there? Theyre deliberately making it hard to find the contact details so they can do what they did with me and say I failed to appeal to the creditor.
    As for emailing the CE I was going to do that as well as a couple of local MP's thanks for leaving his email address.
