A question about : marston baliff !!

Please any advice would be grately appreciated. My partner had a speeding fine. He had been made redundant and was unable to pay in full. It was Ј100. He has been paying Ј35 each month to clear. Last installment i went into the bank to pay on 10th july with the paying in slip paid by cash. My partner has been away for a few days visiting his sick mum in hospital, and yesterday received a call from a baliff to say they were at our house with a distress warrant !! My partner told him he has been paying and we have reciepts. He wasnt interested and said he had to now pay :Ј320!! I left work and went straight home, luckily there was no body there, i locked myself in until my partner got home, i was pettrified. My partner called the Marston Group whosaid they have no record of the payment. But we have the reciept to show paid 10th july. The baliffs again have telephoned to say they are coming back today with the distress warrant for payment or goods.. we only have Ј50.00 to our name and we just dont no what to do. Im so scared. Im not well my self, had to call a ambulance on tuesday as i had a asthma attack, this is stressing me and making me feel so unwell. They are coming at 9am. Can we offer to pay the Ј50 and then installments? Please please help

    were coming at 9am, there not here yet, they texed to say they will be here shortly!
  • do not answer the door to him ,lock your door so he cant walk in he wont get the police,locksmith etc he might say he Will but he wont
    get in touch with bailiffsadviceonline i know its a premium rate phone number but believe me it will save you a fortune and lot of hassle
    I don't have anything to with the company but the owner of site is very very well known to all bailiff firms
  • Can you photocopy the receipt and sellotape it to your front door?

  • move the car don't leave it outside your house or on your drive
  • He said they are not interested in the reciept. He said he has been told to collect the money and said thats what he will be doing.
  • We have moved the car, the car is on finance and in my name so dont think theycan take it for my partners debt anyway.?
  • My partner said to him, so what if we stand in the door and dont let you in, if you touch us we can do you for assult. He said in that case we can get you arrested!!!

    tell your hubby not to get into a confrontation with him he wont win and the police will always take the side of the bailiff and to stop phoning him (if you can video him when/if he comes to your house
    he need to get in touch with fines officer at the court on Monday
  • Sorry to ask the question but i have never ever had to deal with kind of thing before, but how do you know he wont gain entry?
  • Thank you so much for that i will tell him to have a read, thanks for being so help ful.. the bayliff has been and we showed in the reciept. He said he cant check this unt monday. He has given us until tuesday to pay Ј305 .. he seemed reasonable when we showed him the recipt.. i feel sooooooo sick i just cant believe this is happening. Im writing a complaint to marstond and the court now..

    did you receive a further steps notice from the court before it went to marstons
    until tuesday to pay Ј305
    bailiffs fees for court fine enforcement are Ј85 letter fee and Ј215 visit fee
  • The original fine was Ј85, after i charge they said it was Ј100.he only owed Ј30.. he was paying marston group through lloyds bank with paying in slips. They payment they said hasnt been received was the one i paid on 10th july.
  • As you have a receipt for the payment on 10th July, can you query with the bank whether it has been paid into the correct account?
  • My other half is going to the bank on monday to see what has happend. I think they may have paid it but not put the reference number on the payment.. i have written a complaint letter which we are going to send to the court and martson, as this has caused sooooooo much distress for us. If the paymwnt had not been made then fair enough but it HAS been paid.. i can not believe how many things i have found on the net re the marston group and the way they treat people.. its absolutely discusting
  • Marston are one of the worst I've dealt with.
    Stand your ground, stop panicking and stop trying to sort this out with the bailiff, go to the company, send recorded letters, and if you call, get names and confirm the record all their calls.
    Bailiffs can enter through open doors or windows legally for any civil debt, and can force entry for a criminal debt.
  • i'm sorry to hear your having these problems with balifs.
    dont asnwer the door leave open a window, and only comunicate from a upper floor window from now on.
    as far as i see it you paid up your original debt, how enforceable a secondary debt to the account is i dont know.
