A question about : Lowell + BW Legal advice please??

Hi

I am new to this and haven't got a clue what i am doing. I could really do with some advice as i have received a N180 form, from Northampton bulk center last Thursday, and i am not too sure how too reply to it.
To cut a long story short i previously received a N1 form stating i Lowell had request a CCJ against me for a debt i apparently took out in 2007 which i do not recall.
I replied back to the court that i didn't acknowledge the debt and explained that i have sent the claimant a request to supply me proof. I sent letters to Lowell and BW legal recorded requesting them to send me CCA etc i've gave them around 45 days to reply and haven't had know acknowledgement to say they have received my request for a CCA. Only that there client intends to continue with the claim. When i spoke to NCCBC they said that the claimant had not got back to them in gthe required time and that the claim was stayed and that the next step was for me to fill out the N180 form this is all really confusing to me as i don't know where i go from here any advice would be much appreciated.

Many thanks

  • Basically in the 45 days you have set them as a deadline you will have a default CCJ registered against your name.
The game is not yours to play, they are suing you and if you do not file the defence a CCJ is granted automatically.
Now have you made any payments since 2007 ?
If not a defence that the issue is statute barred and you do not recognise or acknowledge any contract or debt to which they refer.
Also request Ј90 expenses be granted for attending court.
Time is short, if you can log in with the key they have given on the form and select defend whole claim and then file a defence.
They are triers and they will turn up at court as they know a certain percentage mess up and that is worth it to them.
Only deal with the court now ! or you will lose, they will mess you about to run the clock down.
Yes they do know what they are doing and this is a tactic.
Forget your deadline, you are not calling any shots here, they are.
  • Thanks Spacey
I don't mean to be stupid i just don't know what i am doing. Like i said i am not sure which date in 2007 i was supposed to have taken this debt out, or when i supposedly defaulted. I had a lot of debts back then, hence why i am not sure how to go forward or file a defense without the information i requested. This is causing me untold stress and sleepless nights sorry i just dont know what to do?
  • Just to confirm i have replied to the N1 Form with the defense that i do not acknowledge the debt. Since then i have a received a notice of proposed allocation to the small claims track from Northampton bulk center. This is the letter i am unsure how to respond to any advice would be much appreciated ?
    Thanks
  • I'm no expert on the court process, but this may help:

your defence is that they have not sent you anything to prove its your debt I presume?
