Hi All,

Many of you are aware of the Allen case in Liverpool due to be heard on the 25th Feb 2015.

Although not as momentous as the Huzar or Dawson case, it certainly has caught the UK's interest and was highlighted in Radio4s Money Box programme https://downloads.bbc.co.uk/podcasts/...0221-1234b.mp3

A question about : Thomson Claim 2 years limit to claim

Recently, Thomson have commenced writing to claimants stating that;
The European court of justice has confirmed that, as the Regulation doesn't say how long passengers have to bring their claims, we need to look at our national law. The supreme court in the UK has said that all claims to do with 'international carriage by air' need to be brought within two years. We therefore can't consider claims for flights that were delayed more than two years ago.

This is a complete and utter falsehood.

But I have received a letter from Thomson advising that as the respondent has appealed against the latest Huzar ruling they are asking the court to stay my hearing.

Any truth in that?
Or just confusion over the 2 year appeal? (Dawson)
