A question about : Emigrating with a debt

My cousin who is currently unemployed and owes about Ј63,000 ( 20k, Ј25k, Ј10k and Ј8k) is currently seriously thinking of emigrating to Canada as we have family there and there is a job waiting for him there.

He is currently paying back Ј150 a month between the four debts. The debts are about 4-5 years old. For past three years he has not missed a single payment (two debts are with debt collectors and the other two are being dealt with by debt collectors for the original banks)

What will his creditors do if he did take this option up?

  • Maybe get a CCJ at his last known UK address which will be waiting for him if he returns.
    Don't know if they can chase in Canada.
    Maybe ask one of the free debt charities such as national debtline or a CAB?

  • I would imagine that they would have a recipricol agreement in place.
    A quick google of UK debt in Canada fetches up a lot of results..
  • Are they realistically going to trace him in Canada ? If he leaves without telling debt collectors where he's going, they're going to have a hard time chasing him if they have no idea where he is. As far as they know he's still in UK, why would they start looking in Canada. If he's thinking of going permanently then he's in a good position and holds all the cards; obviously if he intends to come back to UK he might still be chased by DCA.
  • If there is a job waiting for him why doesnt he keep just keep paying the Ј150? or more once he is settled?

    There *is* a reciprocal agreement with Canada under the Foreign Judgments (Reciprocal Enforcement) Act 1933
    Of course, as others have mentioned a creditor will need to be able to locate you and also gauge whether or not taking legal action would be financially viable.
