A question about : Drydensfarifax committing Libel ???

hi Guys

Looking for a bit of advice and also to see if any one else had had the same with Drydensfairfax. If you have then I would like to join forces with you.
This may need a new thread but I am new to this so if any can help then please feel free to point me in the right direction.

OK Here is my story.
Over 20 years ago I had a house repossessed by my mortgage company. I was not too concerned at the time as there was lots of extra money in the house above the mortgage. It was then sold for way below its market value and I was told that I now owed over 15K
I disputed this at the time and heard nothing for years.
At the start of this year I got letters from Drydensfairfax asking for over 25K to repay the debt.
So I sent the standard statute barred letter and eventually this bunch of cowboys decided I was right. It would have been easy for them to do their home work prior to sending me the letters.

Any way the real point is this.

The first letter that arrived in the post was in my opinion a breach of libel laws. The letter was typed in such a way that you could see through the envelope window that they were claiming I owed all this money. The address window was so big that you could read the amount owed, the old address it referred to and that they wanted to take action.
I disputed that I owed any money and they agreed.
But here is the real problem.
I told them that the way there letter was addressed to me was wrong at that the personal and financial details could be seen. The fact that they were saying I owed a substantial amount of money was clearly visible in the address window.
I believe this is an act of defamation via libel, after all my post man clearly saw what the letter was about and I live in a small village.

I got in touch with Drydensfairfax and they investigated
They have agreed that the letter should not have been sent out in that way and are blaming an error in the way letters were put in envelopes.
They even offered me Ј50 in compensation
I refused saying I believed it was more than an error. I think this is a method they employ so that other household members may discover a debt which could force you to make contact with them. Luckily for me my wife knew all about it.

I wrote to them asking for a full explanation of there offer of compensation. They replied saying it was not compensation but a gesture of good will for their error.

SO HERE IS WHAT I WOULD LIKE TO KNOW
1) Has any one else had a letter from them that clearly shows the amount owing etc through the window part of the envelope.
2) Does any legal buff believe I am correct in that they had committed defamation via Libel, I think they reach all the points to prove.
3) Does any one know a good team of solicitors who would be willing to deal with these cowboys and hit them where it hurts?

If they are wrong they are wrong, but do not accuse me in public ?

  • What really?
    Poor stationary allowed ONE person to see that you owed money?
    How many final demand letters do you think a postman sees in a day?
    I'd say Ј50 compensation is fair.
  • I can't see you having much luck in a libel action: you weren't actually libelled, you did(in fact still do) owe the money. It's just under the Statute of Limitations Act, recovery of said debt is unenforceable. My brother was a postman for a while and they would have competitions between themselves guessing the debt companies on the return address, so your postie didn't see anything he doesn't see many times every day.
