A question about : On a DMP and a PPI-chaser? Support thread!

Hi title=Wave,

I thought it might be good to have somewhere to share knowledge and experiences of being on a DMP while also pursuing a PPI claim. We do have the DMP Mutual Support Thread, which is ace, but we don't want to clog it up with DMP-PPI chat and confuse people title=Smile

So, I've been thinking about chasing up a few accounts in relation to PPI, not for me, but for Mr SAAC who, I'm pretty sure did have PPI misold on at least one account of his.

Right now, I am starting right at the beginning and sending off for copies of the 'original agreement from the lender, which you've a legal right to do for just Ј1, under something called the Consumer Credit Act'.

  • Yep, I was thinking about putting in a claim for PPI from Mr BR's primary CC as when we were struggling to pay, he'd though that was one of the things it covered - and it doesn't. I figure that it can't hurt to ask, right?
    But what can you claim from - credit cards, yes but loans too?
  • If you've taken out a loan, it's likely you would have been offered payment protection insurance (PPI) with it. This is a form of insurance designed to cover your repayments for a year in the event of an accident, sickness or unemployment.
    Payment protection insurance (PPI) itself isn't a bad product. But it's been widely mis-sold with thousands of loans, leaving many paying hundreds for potentially worthless cover. If this applies to you, you may be able to reclaim what you've paid.

    I shall be searching through old paperwork this weekend as I have a feeling I still may have the original loan agreement somewhere...
    I know I was not in employment when the loan was taken out and when I pointed this out to the lady in the bank she had some reason why I should still take out the PPI.

  • Excellent. Well, I've disturbed a few moths but haven't unearthed the original agreements I'd been seeking, so it'll be the CCA letter being sent off tomorrow/Saturday.
    I remember Mr SAAC having some PPI type thing on CC and at least one, maybe two loans. I'm pretty sure I didn't because I would have queried it and been a nuisance, whereas Mr SAAC is far more obliging!
    Anyhow, I figure it's worth the Ј1 + a 2nd class stamp to find out more from the creditors. Hopefully they can give us what we need without having to go down the Ј10 document route.
    Just to buck a trend, let's give ourselves letters rather than numbers:

  • I'm on a DMP with Spectrum. It's got 12 months left to run and they referred me to a company called Curly Wig.
    Curly Wig sent me a pack which I haven't read. Like Spectrum they want to charge for their services - a yet to be determined cut of the payout. Cosnidering I started off in Jan. 2007 with Ј38k worth of debt I could be in for a bit of a windfall.
    My issue with it is that I don't really want to upset my creditors when things have been running smoothly for 5 years. Also, I remember signing many of those PPI things in the belief hat it would help me secure the loan - is that it being mis-sol or is that me just being a mug?
    By the way Spectrum are no longer allowed to take on new custoers so I'm guessing that Curly Wig is an offshoot company designed to keep gouging those of us who fell into debt difficulties.
    Anyway, my question is should I pursue a PPI claim whilst in a DMP. Is it morally the right thing to do. Will I upset my creditors.

  • Curly Wig....?! Are you pulling our legs?!
    On your Qs - on reading up a bit about this it doesn't seem as though pursuing the PPI claim seems to upset creditors - to be honest, it's probably a different department/building/city to their collections department anyhow.
    BUT, this is one of the reasons for this thread so we can support, advise and share info with each other.

  • Right, well, I've sent off the CCA letters. One problem is that one of the accounts I am sure Mr SAAC had some PPI on is now closed and we don't seem to have any paperwork on it. I'm guessing that I just have to send off a letter ro RBS asking them about it - problem is that this sort of letter is very easy for them to ignore.
    Hmmm. anyone anything to report?
  • Nothing to report - other than the fact that Capital One have recently taken out a Ј70 PPI payment from the card - at the same time as asking us not to use it.
    Mr BR will be writing to them to asking them to cancel the PPI with immediate effect.
    That's also the PPI I want to see if we can claim back.
  • Hi everyone - this is my first EVER post.
    I don't know if this is the right forum for this but it sort of fits in with what you are all saying (sort of)... I was on a DMP with Gregory Pennington and i have now cleared all my debts, i am now left with 3 defaults on my credit report from loan & CC companies.
    Can i use the fact that they may have mis-sold me PPI and subsequently put me into difficulties as an argument to get the dafaults removed? to be honest - i would gladly let them keep whatever refunds they offer in exchange for removing the default notices? - is it worth pursuing?

  • I have been on a DMP with the CCCS for nearly 10 years..
    I requested my Credit agreements in Sept 10 as I have 3 still on my plan..
    Tesco Bank agreed I was misold and would refund my PPI on receipt of my statements..I did not have any but did send them my CCCS statement and 3 letters in total they agreed to refund me by Ј389 it was taken off my outstanding balance and I sent the CCCS a copy of letter and they adjusted my Tesco balance.
    The Clydesdale had no details at all and refunded me the Ј10 for the SAR..as they had sold the debt on...I did find one statement showing I had PPI and sent them that and my CCCS statement and they refunded me Ј382 ...it went straight to my outstanding balance and Marlin Financial Services adjusted my figures and I sent a copy to the CCCS ..
    I am still waiting to hear from Bank of Scotland
    It has not affected my DMP or my creditors and it has reduced my plan by 2 years

  • Well... I didn't get around to looking for the paperwork as quickly as I should have done
    But, the good news is, I did (eventually) find the original loan agreement with the details of the PPI on it
    I've filled out the form and it is now on it's way to Lloyds TSB...
    Will post again when/if I hear anything

  • I've asked Mr BR if he has any of the PPI info, or original paperwork, he says he's not sure and will look.
    This was easily 2 weeks ago - I've only remembered now that I asked him about it. I shall have to nag him to look when he gets in.

    I haven't actually found my credit card agreements, but i have found old statements which has the PPI payments on them... will this do to make a claim?

    I could not find my agreements and send in copies of my credit card statements with the PPI questionaire and your reasons for missale.
    I also found 2 credit card statements of my DH who said he never had any PPI and he got refunded from both of them.Virgin and Halifax...

  • Well, I personally have nothing to update. I've heard nothing from the creditors involved and am waiting impatiently.
    But thanks WakeUpCall for dropping in and sharing your experiences - this is so good to know and gives me some extra motivation for dealing with this. And well done on your payouts.

    And welcome little-big-gazza, it sounds like you can get the ball rolling with your statements. At least once you know what you could be entitled to, you can then seek further advice about how to handle things.

  • Received a standard "Thank you for contacting us about your complaint" letter from Lloyds during the week.
    They "are now gathering information and documentation relevant to your complaint to help us assess it further"...
    They say they "will respond to your complaint as soon as we can, and in any event within eight weeks from the date we received your complaint."
    Back to the waiting game...

  • Well...what can I say...pretty gobsmacked right now...
    Got home from work today to find a letter from Lloyds TSB waiting for me. Opened it up, expecting the worst...
    But...they have ACCEPTED my claim
    The PPI premiums paid on my loan were just over Ј2,000 and, with interest, they are going to refund me just over Ј4,000
    This refund works out at just over 40% of the remaining balance of our DMP and will bring our DFD forward by just over a year!!
    Not sure how they will pay the refund - whether they will just knock the amount off what I still owe them (loan, OD and CC still adds up to around Ј5,500) or whether they will send a cheque and we will then pay it to CCCS - and how long all this will take... But the light at the end of the tunnel has just got that much brighter!
