A question about : Diamond resorts "Class Action"

I 've been contacted twice in recent months by a company (Solicitors I believe) who suggest that they are prepared to bring a joint action for illegal selling to members of the Diamond resorts holiday club. I would say at once that I have been a member of this organisation since the late 90's and have had no complaints either about the service provided or the standard of accomodation offered. If there have been problems then they have been sorted out even to the point where a secretary in the MD's office in America has contacted me to ensure a satisfactory outcome.
The basis of the class action relates to the now changed consumer protection rules relevant at the time. Or so it is said. Details are not forcoming but on the last call it was suggested that I could obtain a refund on my initial payment AND still be a member of the organisation taking advantage of the services offered. This is real having cake and eating it stuff and seemed quite implausable. As I've said I'm satisfied with the organisation.
So, my question is has anyone else in MSEland had a similar approach and what is their take on the situation. Has anyone signed up with this company?

  • hi there, i'm a regular reader of the forums but have never felt compelled to reply before so excuse me if i make silly mistakes.
    My parents signed up to Sunterra in the 90s sometime at great expense after gruelling days of 'presentations' by holiday reps. This is now Diamond resorts international and quite frankly is extortionate for what they actually get out of it. They have been looking for a way out for several years after my mother had an extended period of ill health and was not able to travel. I used it on several occasions just so that it wasnt being completely wasted however the accomodations i have stayed at are defo not worth the four figure maintenance fees. They have been approached by a company recently, by sounds of it same one as OP, and have agreed to go to a meeting with them. As OP says it sounds just to good to be true. They will be attending this in next couple of weeks so i'll let you know how they get on. it has become a burden around their necks and with retirement looming its an expense they could do without. They r determined to get this sorted out before they are unable to and myself and sister are burdened with it for another 30 years! anyone invited to a presentation - no matter how good it sounds - NEVER SIGN UP!
  • This is a total con,as you fell for the "Timeshare Con" once, you are the perfect mark to be conned again.You Will Be Robbed Once Again.
    How do i get out of my timeshare contract? i hear you ask,YOU JUST STOP PAYING ANY MORE MONEY TO THESE COMPANIES.
    If you no longer want to use your timeshare weeks/points then just stop paying any more yearly fees.
    If your fees are up to date then send them a letter giving back all rights to use your timeshare/points by recorded delivery.
    If you owe fees then send them a letter telling them you no longer want your timeshare/points.
    You WILL be threatened by mickey mouse pretend lawyers letters saying that you will be made insolvent/bankrupt/county court judgements against you....and so on....NO ONE EVER HAS.
    MAN UP and do the right thing......cowards will pay forever......
  • i have suggested this to them before however they are reluctant to do so. They made a sizable 'investment' into this company and want to recoup some of this money by selling. They r by no means fools and at the time of purchase were very happy with the service and accommodations available at sunterra. Since takeover though the company has lost its exclusivity and maintenance fees have skyrocketed. This has been the major precursor to their wanting to sell. They are going to this meeting very prepared with many many questions and with no intention of doing anything rash without consulting a lawyer. The company have given them a provisional offer for their points however we will be very surprised if that was to materialise. Fingers crossed that something positive will come of this.
  • Timeshare is not an investment,you DO NOT own anything,you cannot sell timeshare,NOBODY will buy your timeshare,anybody that says they can is a LIAR and a CHEAT.
    It is a great temptation to pay about Ј1500 to get Ј7000 back.....IT WILL NEVER HAPPEN,IT HAS NEVER HAPPENED......
    You can try to sell it on Ebay for 1 penny.......not going to happen.
    There are none so blind as those that will not see.
  • Ask yourself this....Why would a timeshare resale company offer to buy your timeshare for Xthousands of pounds when they can buy on Ebay for 99p.
    You must checkout Ebay......just take a look.
  • listen to antenna.DO NOT PART WITH ANY MORE MONEY..don't bother going to any meetings its pointless they will try to get you on to another scam to get you out of the old one
  • I am also a member of a group of people who offer advise of how we have managed to get out of this nightmare..unfortunately you wont get any money back, that has long gone... you have to register to join and it could take up to a week but you will find help with resignation letters etc..

  • we were in a similar situation to Nicustard with our parents trapped in a timeshare contract. Having tried the so called resale market we were lucky enough to get chatting with somebody who had got rid of their timeshare membership and put us in touch with a company ownersescape.com
    for a relatively small fee they got our parents released from their contract in a matter of weeks with no money upfront .
