A question about : Capital One statement of default letter!!

Hi everyone,

I'm looking for a bit of help and advice please from those who have had similar letters and how best to deal with it please.

I just received a letter from Capital One yesterday which was a [B]Statement of Default [B]letter saying the account had now been closed and I officially defaulted on 10/02/2013 and that the account has now been closed and will be recorded on my credit file and maybe passed onto a collections agency etc.

I have just called them to make them aware I send a expenditure form back to them about the 2/2/13 but they haven't received this yet and to call back on Friday to make sure it definitely hasn't been received as it maybe being processed.
the guy I spoke to did confirm the account had been closed and was in default as of the 9/2/13? but he would send another expenditure form out/could do if not received! So not sure where this leaves me tbh.
He did ask if I could make a token payment today - which i did of Ј20 as that's all I could afford, currently the balance is just over Ј700 on a Ј500 limit. The reason the account is over is due to me not working since having my little girl and a couple of months ago not being able to afford the repayments anymore due to circumstances at home changing - so it's just been charges added!

I'm sure I've read somewhere you can ask for charges to be removed and agree to try and settle a lower amount (minus their charges) is this correct and is it something you would recommend me doing? If so how do I go about this please and any advice from those who have tried this would be gratefully received - thank you!

I hope there are a few people who can help and advice me on what's best to do as I'm gutted that it's officially in default :-(

many thanks x

  • Hello,
Sorry i'm new to all this so might not be much help but I can give it my best shot!
Making a token payment is a good start! I believe you can find a template to make a full and final settlement, which they can either agree or disagree to!
Whatever you do don't start a payment plan and promise you can make payment which you can't, I did this and it only gets worse!
    All the best
  • Thank you for the replies, it has given me a bit of a clearer understanding now of where I stand and hopefully we can get it sorted sooner rather than later! x
