A question about : Attendance Allowance

My dad has recently moved permanently into a Nursing Home which is providing him with 24/7 personal care.

He is not self funded but being supported by local council funding; is it possible for me to claim (on his behalf) for an Attendance Allowance ? which can then go towards the Nursing Home fees.

  • No sorry, if he is council funded he will lose his attendance allowance.
  • If he is being funded by Adult Social Services and is in a Nursing home (not a care home) he should also be getting a subsidy from the NHS .. this is different to NHS continuous care.
    About Ј100 plus a week
    His State pension and any private pension will be taken into account (50% of his private pension if he has a wife not in care)..
    The remainder is paid by Social Services with maybe a top up from people like The British Legion or other charities, or the family .
    The only reason for a top up is if the Nursing home you choose has fees higher than Social Services are prepared to pay
    If Social Services had nowhere that fitted into their budget to send him that was available at that time but recommended the home as being fit for his needs, then ...NO TOP UP IS REQUIRED
    They should cover the extra cost
    Your Dad should be left with approx. Ј20 a week pocket money from his income for personal expenditure.
    The rest of his income is paid towards his care, If you have POA then a bill will be sent to you each month which you will need to pay from his bank account

    Not how I read OP,s first post
    His Dad will be required to contribute from any income he receives ..ie State pension.
    People who are funded don't get completely free Nursing Home care.
    This is what makes me very annoyed because there are so many who are blindly convinced that anyone finding themselves in this position just live for free
    The person in care would not be in a position to pay the TOP UP FEE as all their income would have already been taken into account when Social services agreed to subsidise the fees

  • I don't wish to continue the discussion regarding my Dad's details but cavework is correct.
    I have also contacted the Attendance Allowance people in Blackpool who also confirmed that this is the position.

  • Dave, make sure that Dad is getting the NHS subsidy.
    If your Dad has dementia and you don't have POA you would do well to apply for a Court of Protection order
    This then puts you in the position to make any decisions , act on behalf of your Dad and protect him in the future if the fees increase ( which they will) and if Adult Social Services then try to obtain the top up from family members or threaten to move him if you don't comply.

  • pedantic I don't do but I will answer your post
    There are Warden controlled assisted living , residential and residential nursing home care homes.
    If someone asks for advice about a member of their family going into a home that requires 24/7 care I will always try to help because that is the only experience I have and I hope it might help
