A question about : Appeal Letter Against Redundancy

Hi all, can anyone advise me on the best way to write an appeal letter, I wish to appeal on two very different things I think 1.The decision to make someone redundant was unfair as I do not believe that there was a redundancy situation and 2. The way in which I have been made redundant was unfair, statuatory procedure was not followed properly and it felt more like a disciplinary in the end! Any advice greatly appreciated, I can provide much more info but didn't want my post to get clogged up with too much emotion as I fear my appeal letter might :confused:

  • Two employees were under threat of redundancy.
    I had been with the company two years and my colleague one year.
    I was chosen for redundancy and asked to clear my desk then and there and leave, I was even asked to not say goodbyes and the member of staff doing this was ensuring I left the premises. Everything I have read seems to say that as an employer you should be compassionate and have respect for the person that you have eventually had no option other than to make redundant.
    In our small department - the two of us - profits were increasing, we had invoiced Ј8K dec 08 and up to Ј10K jan 09. The reason for redundancy was stated as the rest of the company was 2/3 profit margin our department was not. However in a company where potentially costs needed to be cut because clients were dropping off and revenue decreasing, is it right that costs be cut in a department where revenue is increasing and therefore profits increasing?
    I went on Maternity Leave having been with the company since Nov 06 in Nov 07, having found out I was pregnant in March 07, we took on my colleague to look after the clients I had built up and grow the area. My colleague started August 07. I returned to work July 08 and had worked a total of two days per week through the summer (using holiday one day per week) and then three days per week since then.

  • Would really recommend going to the Citizens Advice Bureau, and also seeing if there is a free legal advice centre near you. I got made redundant yesterday and knew I would appeal as the selection matrix was in my opinion not marked objectively (I was in a closed selection pool with another colleague), luckily I'd already arranged to see a lawyer through this advice centre, she wrote an appeal letter on by behalf which covered the points without going into too much detail.
    Another point: If your colleague and yourself did the same job role then there should have been a selection matrix (like mine) where you were both objectively scored against this and the person with the lower score would be put forward for redundancy.
