A question about : Any point in a subject access request?

Hi All,

I was hoping you guys could help me with a PPI claim I am making. I have recently made a PPI Credit card claim that was won in my favour however the amount was quite small (I was expecting more!). The lender said it could not find statements from 1994 to 2001 and therefore used averages. Unfortunately I do not have any statements for this time period that I can present myself to them.

I was wondering if it was worth me going through a subject access request? (The lender said it was unlikely that it will lead to me finding more information then what they already found. Although I don't know If they were saying this to put me off).

Or shall I just go straight to the financial ombudsman? (I mentioned that I may go to them to the lender and they said it is unlikely it will lead to a better pay out. Again I feel this was said to put me off).

Also can I cash in the cheque they have already given me? (with the small amount) or is this an admission of defeat and acceptance I do not want to pursue the matter?

  • They don't have the statements anymore. FOS don't have your statements either so not sure why you think they can help. You have no evidence to prove you paid more.
    The bank have no reason to lie, they would get in heaps of trouble with the FCA for lying to you. If you don't believe them then pay the Ј10 for a DSAR but will probably be a waste of a tenner.
